PARCEL MAP FOR PROPERTY LOCATED ON THE WEST SIDE OF NORTH
PEACH AVENUE BETWEEN EAST MCKINLEY AND EAST OLIVE AVENUES.
The City of Fresno Planning Division has completed its review of the subject parcel map dated July 9,
2004. Pursuant to Fresno Municipal Code FMC Section 12-1205(c), this letter is written to advise that
the Conditions of Approval dated October 8, 2004, are as noted on the attached document.
If you have any questions regarding the conditions you must notify either Louis Rocha or Paul Bernal
at 621-8073 no later than October 14, 2004, to request a review of the conditions. Otherwise, the
stipulated conditions of approval are in effect as of that date. No further notice will be sent.
Appeal: The divider or any aggrieved person may file an appeal regarding to conditions of approval
within fifteen (15) days from the date of approval.
To protest the Director's decision regarding the conditions of approval, you must appeal by filing a
written appeal with the Director of the Development Department. Appeal must include the appellant's
interest in/or relationship to the subject property, the decision or action appealed, and specific
reasons why the appellant believes the decision or action appealed from should not be upheld
Appeals must be submitted to the Director of the Development Department prior to 5 p.m. on October
26, 2004.
EXPIRATION: The approval or.conditional approval of this tentative Parcel Map expires two years
from the date of approval. The expiration shall terminate all proceedings and a final Parcel Map may
not be filed without first processing a new Tentative Parcel Map.
Modification of a Tentative Parcel Map after approval or conditional approval does not extend the two
year time limit.

EXTENSION: The divider may request an extension of the tentative map expiration date by filing a
written application together with the fee set forth in the Master Fee Schedule at the time of the
request with the Director of the Development Department at least thirty days before the expiration
date of the map. The applicant must state the reasons for the requesting the extension. New
conditions may be imposed if an extension is granted.
An extension may not exceed an aggregate of five years.

BACKGROUND
Revised Tentative Parcel Map No. 2000-11, "A Planned Development" filed by Larry Empereur on
July 1, 2004, and accepted on July 9, 2004, proposes to subdivide a 6.68 acre parcel into four
parcels. The parcel map site is located on the west side of North Peach Avenue between East
McKinley and East Olive Avenues. The parcel map was originally approved by the Planning Director
on August 2, 2000. The revised map was submitted showing an increase in lot area for proposed
Parcel "A". The site is planned for general heavy commercial land uses by the 2025 Fresno General
Plan, Roosevelt Community Plan and the Fresno Yosemite International Airport and Environs
Specific Plan and is zoned C-M, (Commercial and Light Manufacturing). The proposed C-M zoned
subdivision maybe deemed to be consistent with the 2025 Fresno General Plan, Roosevelt
Community Plan and the Fresno Yosemite International Airport and Environs Plan planned land use
designation of general heavy commercial by requiring the applicant to file a rezone application
changing the zoning from the C-M to C-6 zone district. Alternatively, the applicant may record a
covenant affecting land development restricting land uses of the C-M zone district to those uses
permitted by right or by conditional use permit in the C-6 zone district. The applicant has since filed
Site Plan Review Application No. S-04-277 which is a request to establish the "Planned
Development" and private road for Tentative Parcel Map No. 2000-11. Staff has required Exhibit "A"
dated July 1, 2004, for Site Plan Review Application No. S-04-277, be titled a "Planned Development"
and the site plan shall reflect the property lines as proposed by Tentative Parcel Map No. 2000-11
dated July 9, 2004. The planned development is required because the applicant's parcel map is
proposing the creation of parcels that due not have access to a public street or public right-of-way.
Approval of this tentative parcel map is subject to the Planning and Development Director finding that
the map is consistent with the officially adopted plans and policies of the City of Fresno. .
REQUIRED FINDINGS
California Environmental Quality Act (CEQA)- The California Environmental Quality Act (Public
Resources Code Section 21000 et seq.) permits a public agency to determine whether a particular
project is exempt from CEQA. Environmental Assessment No. TPM 2000-11 (Categorical Exemption)
was completed and resulted in the finding of a Categorical Exemption (Section 15315/Class 15 Minor
Land Divisions) from CEQA dated on October 8, 2004 and filed with the Fresno City Clerk on the
same day.

STATE SUBDIVISION MAP ACT- The Subdivision Map Act (California Government Code Section 66410
et. seq.) requires that a proposed parcel map not be approved unless the map,-together with its design
and improvement, is found to be consistent with the General Plan and any applicable specific plan
(Finding No. 1 below). State law further provides that the proposed parcel map be denied approval if any
one of the Finding Nos. 2-5, below, is made in the negative.
1. The existing zoning of the site does not conform to the "Planned Land Use and Zone District
Consistency Matrix" located in Table 2 of the 2025 Fresno General Plan. Pursuant to the matrix,
General Heavy Commercial Land Uses are consistent with the C-4, C-5, C-6 C-R, S-L, and P
zone districts. However, it has been determined that consistency can be established by
rezoning the property to the C-6 (Heavy Commercial) zone district or with the recodation
of a covenant limiting development of the site in accordance with the C-6 (Heavy
Commercial) standards and requirements.
2. The site is physically suitable for the proposed type and density of development because of the
flat terrain of the site and adequate access and drainage on and off the site.
3. The proposed parcel map design and improvements are not likely to cause substantial and
considerable damage to the natural environment, including fish, wildlife or their habitat, because
of the urbanized nature of the area in which the site is located.
. 4. The proposed parcel map design and improvements are not likely to cause serious public health
and safety problems, because the conditions of approval have shown and will insure that the,
subdivision conforms with City health and safety standards.
5. The proposed parcel map design will not conflict with public easements within or through the site
because conditions of approval will assure noninterference with any existing or proposed public
easements.
Staff, based on its own analysis, has determined that the parcel map, subject to the recommended
conditions of approval, otherwise complies with the design and property development standards of the
Zoning Ordinance and local Parcel Map Ordinance and recommends the approval of the parcel map.
DIRECTOR DETERMINATION
1. Based upon the above analysis, the Planning and Development Director finds that Tentative
Parcel Map No. 2000-11 is consistent with the applicable plans and policies of the City of Fresno.
2. The Planning and Development.Director hereby grants approval of Tentative Parcel Map No.
2000-11 dated July 9, 2004, subject to the conditions of approval dated October 8, 2004, and to
become effective on October , 2004.

PROJECT DESCRIPTION: Site Plan> Review Application No. S-04-277 requests authorization to
construct a private road that will provide vehicular access to the proposed
parcels of Tentative Parcel Map No. 2000-11 while also maintaining
emergency access to Parcels "B" and "C of Parcel Map 88-56.
Tentative Parcel Map No. 2000-11 "A Planned Development," proposes
to subdivide the 6.68 acre site into four parcels.
This project is exempt under Section 15303/Class 3 and Section 15315/Class 15 of the California
Environmental Quality Act (CEQA) Guidelines.
EXPLANATION: Section 15303/Class 3 exempts from the provisions of CEQA,
construction and location of limited numbers of new, small facilities or
structures; installation of small new equipment and facilities in small
structures; and the conversion of existing small structures from one use
to another where only minor modifications are made in the exterior of the
structures described.in this section are the maximum allowable on any
legal parcel. Examples of this exemption include but are not limited to:
(d) Water mains, sewage, electrical, gas, and other utility extensions,
including street improvements, of reasonable length to serve such
construction. Section 15315/Class 15 consists of the division of property
in urbanized areas zoned for residential, commercial, or industrial use
into four or fewer parcels when the division is in conformance with the
General Plan and zoning, no variances or exceptions are required, all
services and access to the proposed parcels to local standards are
available, the parcel was not involved in a division of a larger parcel
within the previous 2 years, and the parcel does not have an average
slope greater than 20 percent

is not consistent with the 2025 Fresno General Plan, Roosevelt Community Plan and the Fresno

requiring the applicant to file a rezone application changing the zoning from the C-M to C-6 zone
district which is consistent with the general heavy commercial planned land use or record a covenant
affecting land development restricting land use and land development of the C-M zone district to

"Planned Development"
NOTICE TO PROJECT APPLICANT
In accordance with the provisions of Government Code §66020(d)(1), the imposition
of fees, dedications, reservations or exactions for this project are subject to protest
by the project applicant at the time of approval or conditional approval of the
development or within 90 days after the date of the imposition of the fees, dedications,
reservations or exactions imposed on the development project.
The City of Fresno Planning and Development Department has completed a review of the subject
tentative parcel map in accordance with the State Subdivision Map Act and the Fresno Municipal
Code. The conditions of approval for Tentative Parcel Map No. 2000=11 are as follows:
LEGAL STATUS OF SITE TO BE SUBDIVIDED
1. The parcel map site, was legally created as Parcel "A"of Parcel Map No. 88-56.
ZONING Cove --
2. The existing zoning of the site does not conform to the"Planned Land Use and Zone
District Consistency Matrix" located in Table 2 of the 2025 Fresno General Plan.
Pursuant to the matrix, General Heavy Commercial Land Uses are consistent with the
C-5 and C-6 zone districts. However, it has been determined that consistency
can be established by rezoning the property to the C-M (Commercial and Light
Industrial) zone district or with the provision of a covenant limiting
development of the site in accordance with the C-6 (Heavy Commercial)

PLAN CONSISTENCY
4. The 2025 Fresno General Plan, Roosevelt Community Plan, and Fresno Yosemite
International Airport Plan designate the parcel map for development with General
Heavy Commercial type land uses. The Zoning District Consistency Table of the
Fresno Municipal Code identifies general heavy commercial land uses as consistent
with the C-5 and C-6 zone districts.
5. Consistency may be established by rezoning the property to the C-6 (General
Heavy) zone district which is consistent with the general heavy commercial
land use or by the provision of a covenant providing for the development of the
site in accordance with the C-6 District standards and regulations.
6. All covenants or agreements will be prepared upon receipt of the fee indicated
below. Covenants must be approved by the City Attorney's Office prior to the
issuance of building permits.
• Submit the following documentation for the preparation of the required
covenant agreement providing for the development of the site in accordance
with the C-P District standards and regulations: Title Report within the last
6 months.
• Remit $250.00 fee for preparation and processing of the covenant(s) or
agreement(s)
SUBDIVISION MAP ACT REQUIREMENTS
7. Concurrent with the filling of a final map and when the provisions of Section 66436 of
the Subdivision Map Act apply,the subdivider is responsible to send, by certified mail,
a sketch of the proposed final map, together with a copy of SMA Section
66436(a)(3)(A), to any public entity or public utility which has previously acquired a
right-of-way easement.
8. Comply with provision of the State of California Government Code Sections 66410-
66499.58 (the Subdivision Map Act) and the City of Fresno Municipal Code Chapter
12, Article 10 (Subdivision of Real Property).
MODIFICATIONS TO PROPERTY DEVELOPMENT STANDARDS
9. Proposed parcels must be consistent with approved C-M, (Commercial and Light
Industrial/Urban Growth Management/conditions of zoning)zone district for the parcel
map site in terms of lot width, depth, height, and area subject to approval of a special
permit for a planned development project. All parcels must provided access to a
public street right-of-way under a planned development special permit.

Planning and Development Department Director on August ; 2004 This site plan.
shall authorize the creation of the planned development on the parcel map site.
10. Submit draft copies of Covenants, Conditions and Restrictions/Owners Association
documents (CC & R's) for review and approval. Final, executed and notarized
documents are to be recorded with the parcel map. CC & R's shall conform with the
provisions of Section 12-1026 FMC and address ingress, egress, sewer and water
service, maintenance, and access, fire protection, solid waste service, storm
drainage, parking and landscaping as follows:
• Cross Access for ingrees/egrees
• Cross Drainage as indicated per Flood Control District's Memo
• Covenant for Shared'Parking
• Covenant to maintain water, sewer and all other utilities
• Covenant for fire protection underground water supplies and Covenant for
access to buildings
• Covenant to maintain all landscaping within the limits of the map
• Covenant for shared solid waste facilities
• Provide Covenant Agreement for access to land locked parcels
Provide Covenant Agreement for maintenance of fire suppression water
system.
11. The placement of a parcel line in close proximity to any existing and/or proposed
structures requires the structures be found in compliance with the fire resistive
standards of the Uniformed Building Code, Chapter 5. In the event the structures do,
not comply they must be modified so as to meet the requirement.
12. The proposed structure(s) on the site may be.affected due to the location of the
proposed parcel line. Compliance with the prevailing Uniform Building Code as it
relates to the exterior wall protection,allowable area,etc. (as applicable to new parcel
line locations) must be demonstrated prior to final map submittal. Contact Planning
and Development Department, Building and Safety Services at 621-8200.
GENERAL PUBLIC WORKS REQUIREMENTS
Dedications
13. The subdivider shall dedicate public easements to facilitate the construction of curbs,
gutters, sidewalk, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose
trail, wheelchair ramps and public utilities in accordance with City plans, ordinances,
resolutions and policies,the Standard Specifications of the Public Works Department
within the limits of the parcel map. Additionally, a minimum 4 foot wide clear path of
travel is required along the public sidewalk on all frontages of the property as required
by Title 24 of the California Administration Code as determined by the City Engineer.

An on-site pedestrian easement and construction of a path may be required if Title
- 24 provisions can not be met within the public rights of way. All such public
easements shall be identified and dedicated with the processing and recordation of
the Parcel Map or at the time of Special Permit reviews for the proposed development
of.the parcels.
Street improvements
14. The subdivider shall construct curb, gutters, curb returns and landings, wheelchair
ramps, sidewalks with street tree wells and irrigation systems (when applicable),
permanent pavement,street/safety lighting,bike lanes,bike paths, multi-purpose trail,
walls and fences in accordance with City plans, ordinances, resolutions, policies and
the Standard Specifications of the Public Works Department within the limits of the
parcel map.
15. Existing improvements that are not to the planned alignment shall be removed and
required improvements, installed to the new street alignment and grade. Existing
improvements to remain in place shall be repaired if determined to be damaged
and/or off grade by the City Engineer. Existing driveway approaches not identified for
current or future utilization shall be removed and sidewalk(when applicable),curb and
gutter shall be installed to match existing or proposed street line and grade as
determined by the City Engineer.
Sanitary Sewer System
16. The subdivider shall connect each parcel being created to.the City of Fresno's
sanitary sewer system with . a separate sewer house branch unless other
arrangements are approved by the City Engineer. All sanitary sewer system
improvements shall be constructed in accordance with City plans, ordinances,
resolutions,policies and the Standard Specifications of the Public Works Department.
The connection to the City's sanitary sewer system requires the payment of all
applicable sewer connection charges in accordance with the provisions of FMC
Chapter 9, Article 5 prior to the approval of the map.
Water System
17. The subdivider shall connect each parcel being created to the City of Fresno's water
system with a separate water service and meter unless other arrangements are
approved by the City Engineer. All water system.improvements shall be constructed
in accordance with City plans, ordinances, resolutions, policies and the Standard
t Specifications of the Public Works Department. The connection to the City's system
requires the payment of all applicable water connection charges in accordance with
the provisions of FMC Chapter 14, Article 1 prior to the approval of the map.

Street, Sewer and Water Construction Plans
18. The subdivider shall provide street, sewer and water construction plans for the
required public improvements as determined by the City Engineer. Such plans shall
be prepared by a registered Civil Engineer and approved by the City Engineer prior
to the issuance of Street Work permits.
ON-SITE REQUIREMENTS
19. The subdivider may either construct the required off-site improvements prior to the
approval of the final parcel map; or enter into an agreement with the City of Fresno
providing for the construction of the required improvements and sufficient security
prior to the.approval of the final parcel map.
20. All off-site and public improvements shall be constructed in accordance with the
Public Works Department Standards, Specifications and Policies. Engineered
construction plans and estimates for all or part of the required work shall be required
prior to the issuance of Street Work Permits unless otherwise determined by the City
Engineer. The cost for such plan preparation, review and construction inspection
shall be at the subdivider's expense.
21. Any existing utilities, including but not limited to, street lights, traffic signals, fire
hydrants, poles (power, telephone, cable, etc), fire hydrants which must be relocated
or removed in conjunction with the construction of these off-site improvement.

22. All existing overhead utilities, including but not limited to, electrical systems,

submitted for review and approval by the Traffic Engineer prior to the issuance of
permits for the work. Services to street lighting installations shall be separated from
the electrical service(s) serving the development. The type, location and service for
street lighting installations shall be as determined by the Traffic Engineer. Street
lighting installations shall be dedicated to the City upon completion and acceptance
of the installations.
24. On-site Sewer and/or Water System(s). All on-site sewer and water systems shall be
"private". In the event the subdivider proposes to construct "public" on-site sewer
and/or water systems facilities, written approval by the Public Utilities Department
shall be required and provided with the submittal of the initial final parcel map. Such
facilities shall placed in a dedicated easement and shall be included as public
improvement requirements for the parcel map.

25. Sidewalks (including wheelchair ramp landings) and driveway approaches, for
undeveloped parcels of this parcel map, shall be required as a condition of site
- development.
26. Easements: Identify the location, type, size, and record information_ of easements on
and through the site must be shown on the final map.
27. If P.G. &E. has an existing pole line that serves the property and the existing pole line
crosses proposed property lines and is not covered by an existing easement, it is the
property owner's responsibility to provide adequate rights-of-way to P.G. & E.
If P.G..& E's. assistance is required to determine whether an easement will be
required contact Scott Combs, Senior Land Technician, Fresno Land Rights Office,
at 263-7375.
28. Unless otherwise noted, all covenants or agreements will be prepared upon receipt
of the fee indicated below. Covenants must be approved by the City Attorney's Office
prior to issuance of building permits.
29. Telephone, cable, and other public utilities which propose above-ground facilities
determined by the Planning and Development Director to be oversized shall be
located in an additional easement area outside of the landscape strips required along
major streets.
30. All work and engineered plans for public improvements shall conform to the 2002
Edition of the City of Fresno Standard Specifications and Drawings (City Council
Resolution No. 70-36 and Resolution No. 84-361) and any amendments thereto,
hereinafter referred to as the "Public Works Standards".

development on Parcel "D"which will require all buildings proposed on that parcel to

33. All required signing and striping shall be done and paid for by the developer/owner.
The signing and striping plans shall be done per the current CalTrans standards and .
shall be submitted as a part of the street construction plans for this tentative map to
the Public Works Department for review and approval.
34. Repair or replace any existing damaged off-site concrete improvement to Public.
Works Standards.
35. Additional off-site improvements will be required at the time of future site plan review.
36.. Underground all existing offsite overhead utilities within the limits of this map as

41. Extension of a 8-inch sewer main in the proposed private road from North Peach
Avenue west. Provide sewer service to each lot created.
42. Separate sewer house branches are required for each lot.
43. Engineered improvement plans prepared by a Registered Civil Engineer are required

45. Upon connection of this Project to the City Sewer System the owner shall be subject
to payment of Sewer Facility charges per Fresno Municipal Code Section 9-505.1 and
9-505.2. Sewer Facility charges consist of two components,a Wastewater Facilities
Sewer Charge and Trunk Sewer.Charge where applicable.
46. Sewer Facility Charges are collected after occupancy on a bi-monthly basis overtime
based on metered (water or sewer effluent)usage. The developer may contact the
Department of Public Utilities (6559) 621-8554 to receive an estimated cost of the
Sewer Facility Charges applicable to the project (based on a constant sewer
discharge and loading (Biochemical Oxygen Demand [BOD] and Total Suspended
Solids[TSS] levels anticipated) at the current rates in effect, at the time per Fresno's
Master Fee Resolution. The developer shall provide data regarding estimated sewer
discharge rates [flow] and loading [BOD/TSS levels] required for calculating the
estimated charges.
WATER SERVICE
A 12-inch water main is located in North Peach Avenue and is currently available to provide water
service to the site subject to the following requirements:

6. The Federal Clean Water Act and the State General Permits for Storm Water Discharges
Associated with Construction and Industrial Activities (State General Permits) require developers
of construction projects disturbing five or more acres, and discharges associated with industrial Ma
activity not otherwise exempt from National Pollutant Discharge Elimination System (NPDES)
permitting,to implement controls to reduce pollutants, prohibit the discharge of waters other than
storm water to the municipal storm drain system, and meet water quality standards. These
requirements apply both to pollutants generated during construction, and to those which may be
generated by operations at the development after construction.

State General Permit for Storm Water Discharges Associated with Construction
Activities, approved August 1999, (modified December 2002.) A State General
Construction Permit is required for all clearing, grading, and.disturbances to the ground
that result in soil disturbance of at least one acre (or less than one acre if part of a larger
common plan of development or sale). Permittees are required to: submit a Notice of
Intent to be covered and must pay a permit fee to the State Water Resources Control Z
Board (State Board), develop and implement a storm water pollution prevention plan,
eliminate non-storm water discharges, conduct routine site inspections,train employees O
in permit compliance,and complete an annual certification of compliance. ■

b. State General Permit for Storm Water Discharges Associated with Industrial Activities, O
April, 1997 (available at the District Office.) A State General Industrial Permit is O
required for specific types of industries described in the NPDES regulations or by
Standard Industrial Classification (SIC) code. The following categories of industries
are generally required to secure an industrial permit: manufacturing; trucking; O
recycling; and waste and hazardous waste management. Specific exemptions exist for
manufacturing activities which occur entirely indoors. Permittees are required to:
submit a Notice of Intent to be covered and must pay a permit fee to the State Water
Resources Control Board, develop and implement a storm water pollution prevention
plan, eliminate non-storm water discharges, conduct routine site inspections, train
employees in permit compliance, sample storm water runoff and test it for pollutant
indicators, and annually submit a report to the State Board.

FLOOD PLAIN POLICY
Primary Flood Plains
Because of the relatively high velocities and volumes of flood flow associated with primary flood
plains, and because the primary flood plain is responsible for passing the greatest percentage.of the
flood event,development located in such flood plains is subject to substantial risk,both to itself and
to others as a result of the potential for blockage and diversion of flood waters. In view of these
factors, the following policy statement is proposed:
Policy 1) All proposed development activity shall be the subject of a detailed
hydrological flood hazard investigation to determine the relationship of the
proposed development to the secondary flood plain and the primary flood
plain;and,further,to identify the estimated high water elevation of the 100-
year flood event.
2) All development and/or permanent improvement activity which, if located
within the primary floodway, may unduly impede, retard, or change the
direction of flow of water either,by itself,or by the catching or collecting of
other debris or is placed where the flow of water would carry such
obstruction downstream to the damage or detriment of either life or property,
should not be permitted.
Secondary Flood Plains
Because development within secondary flood plains is subject to inundation,but without the threat of
increased velocities of floodwaters,and because the excessive development of the secondary flood
plain can result in increased water surface elevations through displacement of flood waters, the
following policy statement is suggested:
Policy L) Development in secondary flood plains is generally acceptable when a
detailed hydrological flood hazard investigation report had been prepared
indicating that the area proposed for development is located within a
secondary as opposed to a primary flood plain.
2) The development must be properly flood proofed below the estimated high
water elevation of the 100-year flood event.
3) The development is accomplished is such a way as to prohibit the
displacement of any and all flood waters from that portion of the flood plain
to be developed.
