Pursuant to FMC Section 12-1205(c), this letter is written to advise that the conditions of approval are as noted on the attached document, dated August 13, 2002. If you have any questions regarding the conditions you must notify either Louis Rocha or Robert Lewis at 498-4451 no later than August 19, 2002, to request a review of the conditions. Otherwise, the stipulated conditions of approval are in effect as of that date. No further notice will be sent. Appeal: The divider or any aggrieved person may file an appeal regarding to conditions of approval within fifteen (15) days from the date of approval. To protest the Director's decision regarding the conditions of approval, you must appeal by filing a written appeal with the Director of the Development Department. Appeal must include the appellant's interest in/or relationship to the subject property, the decision or action appealed, and specific reasons why the appellant believes the decision or action appealed from should not be upheld Appeals must be submitted to the Director of the Development Department prior to 5 p.m. on August 30, 2002. The expiration shall terminate all proceedings and a final Parcel Map may not be filed without first processing a new Tentative Parcel Map. Modification of a Tentative Parcel Map after approval or conditional approval does not extend the two year time limit. EXTENSION: The divider may request an extension of the tentative map expiration date by filing a written application together with the fee set forth in the Master Fee Schedule at the time of the request with the Director of the Development Department at least thirty days before the expiration date of the map. The applicant must state the reasons for the requesting the extension. New conditions may be imposed if an extension is granted. An extension may not exceed an aggregate of five years. The conditions of approval for Tentative Parcel Map No. 2000-10 are as follows: NOTICE TO PROJECT APPLICANT In accordance with the provisions of Government Code §66020(d)(1), the imposition of fees, dedications, reservations or exactions for this project are subject to protest by the project applicant at the time of approval or conditional approval of the development or within 90 days after the date of the imposition of the fees, dedications, reservations or exactions imposed on the development project. I. Legal Status of Site to be Subdivided A. The parcel map site, was legally created in the County of Fresno prior to 1972. II. Zoning A. Proposed parcels are consistent with the M-1 zoned, light industrial, district for the parcel map site in terms of lot width, depth and area. All parcels will have approved access to a public street or right-of-way. B. All parcels shall be used and developed in accordance with the M-1 zone. 111. Plan Consistency A. The Bullard Commnity Plan designates the parcel map site for development with light industrial land uses. The Zoning District Consistency Table of the Fresno Municipal Code identifies light industrial land uses as consistent with the C-M, M-1, M-1-P and S-L zone districts. The existing M-1 zone district is consistent with the light industrial land use designation. Conditions of Approval Tentative Parcel Map No. 2000-10 Page 2 August 13, 2002 B. The parcel map site is subject to City's Master Trails Plan and Multi-Purpose Trails Manual for West Herndon Avenue. IV. On-Site Requirements A. Fresno Metropolitan Flood Control District requirements: Flood Control requirements will not be available until February 19, 2002. Contact the Fresno Metropolitan Flood Control District at (559) 456-3292. B. Easements: The location, type, size, and record information of easements on and through the site must be shown on the final map. A 12-inch P. G. & E. Company transmission pressure gas line traverses the project site. Provide a minimum 20-foot public utilities easement in accordance with P. G. & E.'s letter dated February 6, 2002 Provide Public Utility Easements (PUE) which may be required for P. G. & E. use. It is the owner's responsibility to provide P.G. & E. with adequate rights- of-way satisfactory to P.G. & E. If the property owner needs P.G. & E. to help assist in making the determination if an easement will be necessary, the property owner or their agent may contact the Scott Combs,_ Land Agent, Fresno Land Rights Office at 263-7375. The developer/owner will be responsible for the costs associated with any removal or relocation of existing facilities on the property. C. Irrigation Canals and Ditches: 1. Any private irrigation canals through the site are required to be piped and such pipelines shall be provided with an appropriate easement. This requirement will be deleted upon submittal of acceptable documentation that all down-stream uses of this facility have abandoned their rights in this facility. 2. INTERIOR LOCAL INDUSTRIAL STREET -- Within the limits of the parcel map the owner shall dedicate the interior local industrial streets to a 72-foot right-of-way and construct all curbs, gutters, permanent paving, and an underground street lighting system on the interior local industrial streets to Public Works standards. The curb and gutter shall be constructed to accommodate a 10-foot sidewalk pattern within the limits of the map. Construct an underground street lighting system per Public Works Standard E-1 within the limits of the map. Spacing and design shall conform to public works standard for collector streets. The local industrial street to be dedicated with the parcel map is proposed to connect to West Herndon Avenue at the southeast corner of the project. A waiver of access to West Herndon Avenue from this site has been granted to the State of California. Until such time as the waive a access to West Herndon Avenue is vacated, the developer shall provide an easement and temporary turnaround as proposed on the tentative map. Should the developer be unable to obtain the vacation of the waiver of access to West Herndon Avenue, the owners of all the parcels shall provide for the dedication of a easement for public street right-of-way for the cul-de-sac. The owner all parcels shall also be responsible for the construct the permanent cul- de-sac, including curb, gutter and sidewalk, if required, to Public Works Standards. The owner shall enter into a covenant agreement guaranteeing dedication of the easement for public street right-of-way for the cul-de-sac and its construction. The covenant agreement shall include a time limit agreed to by the owner and the City of Fresno limiting the time in which the developer or owners have to acquire vacation of the access waiver and completion of the cul-de-sac improvements. B. NORTH GOLDEN STATE BOULEVARD -within the limits of the parcel map the owner shall dedicate a 6-foot easement for public street right-of-way to Conditions of Approval Tentative Parcel Map No. 2000-10 Page 4 August 13, 2002 accommodate a 96-foot standard collector width throughout the limits of the map. Construct concrete curb and gutter, 20 feet of permanent paving, and any transition paving as required from the existing edge of pavement within the limits of the map. The curb and gutter shall be constructed to accommodate a 10-foot sidewalk pattern within the limits of the map. Construct an underground street lighting system per Public Works Standard E-1 within the limits of the map. Spacing and design shall conform to Public Works Standards for arterial streets. Contact the Public Works Department, Engineering Services Division, Project Design (559-498-1602) for detailed information. VI. Off-Site Improvement Requirements A. Caltrans Requirements No water from the proposed project shall flow into State right-of-way without approval from the District Hydraulic Engineer. An Encroachment Permit must be obtained from Caltrans for any work within the State right-of-way. Engineering drawings of all work are to be submitted with the application and may be prepared in Metric or dual units (English and Metric). If using dual units, the preferred method is English first with Metric in parenthesis. Work planned within the State right-of-way will be performed to State standards and specifications at no cost to the State. Plans for said work need to be review and approved by the Permit Department and the Environmental Planning Branch of Caltrans before a permit can be issued. Permits will be issued in accordance with Caltrans, (Streets and Highways Code (S&HC)," Section 671.5, "Time Limitations." B. Sanitary Sewer System A 54-inch public sanitary sewer main exists in North Grantland Avenue at West Bullard Avenue. The following conditions are required to provide sanitary sewer service to the proposed parcels. Conditions of Approval Tentative Parcel Map No. 2000-10 Page 5 August 13, 2002 A 24-inch and an 18-inch public sanitary sewer mains shall be extended northerly in North Grandland Avenue from West Bullard Avenue to West Herndon Avenue at North Golden State Boulevard. A public sanitary sewer main is to be extended northerly in North Golden State Boulevard from West Herndon Avenue along the entire frontage of the proposed parcel map. IV Separate sewer house branches shall be provided for each proposed parcel. All sewer facilities shall be constructed according to Public Works Standards and policies. Prior to placement of any permanent street surfacing, the developer shall be required to construct any sewer mains necessary to serve adjacent properties. C. Water Service A 14-inch PVC water main exists in West Bullard Avenue at North Bryan Avenue. The following conditions are required to provide water service to the proposed parcels. Two independent points of connection to the City water system are required to serve the proposed parcel map land division or any phase thereof. j _4L—A 16-inch public water main shall be extended westerly in West Bullard Avenue from North Bryan Avenue to North Grantland Avenue, then northerly in North Grandland Avenue to West Herndon Avenue, then easterly in West Herndon Avenue to North Golden State Boulevard. -�--A public water main shall be extended northerly in North Golden State Boulevard from West Herndon Avenue along the entire frontage of the parcel map. separate water services shall be provided for each proposed parcel. Fire Department 1. All buildings within Parcel Map No. 2900-10 site shall be constructed with a fire sprinkler system approved by the Fresno Fire Department. F. Parks/Public Works Tree Requirements 1. Comply with the memorandum dated March 4, 2002. VII. GENERAL PUBLIC WORKS REQUIREMENTS A. DEDICATIONS. The subdivider shall dedicate public easements to facilitate the construction of curbs, gutters, sidewalk, bus bays, right turn lanes, bike lanes, bike paths, multi-purpose trail, wheelchair ramps and public utilities in accordance with City plans, ordinances, resolutions and policies, the Standard Specifications of the Public Works Department within the limits of the parcel map. Additionally, a minimum 4 foot wide clear path of travel is required along the public sidewalk on all frontages of the property as required by Title 24 of the California Administration Code as determined by the City Engineer. An on-site pedestrian easement and construction of a path may be_required if Title 24 provisions can not be met within the public rights of way. All such public easements shall be identified and dedicated with the processing and recordation of the Parcel Map or at the time of Special Permit reviews for the proposed development of the parcels. B. STREET IMPROVEMENTS. The subdivider shall construct curb, gutters, curb returns and landings, wheelchair ramps, sidewalks with street tree wells and irrigation systems (when applicable), permanent pavement, street/safety lighting, bike lanes, bike paths, multi-purpose trail, walls and fences in accordance with City plans, ordinances, resolutions, policies and the Standard Specifications of the Public Works Department within the limits of the parcel map. Existing improvements that are not to the planned alignment shall be removed and required improvements installed to the new street alignment and grade. Existing improvements to remain in place shall be repaired if determined to be Conditions of Approval Tentative Parcel Map No. 2000-10 Page 7 August 13, 2002 damaged and/or off grade by the City Engineer. Existing driveway approaches not identified for current or future utilization shall be removed and sidewalk (when applicable), curb and gutter shall be installed to match existing or proposed street line and grade as determined by the City Engineer. C. SANITARY SEWER SYSTEM. The subdivider shall connect each parcel being created to the City of Fresno's sanitary sewer system with a separate sewer house branch unless other arrangements are approved by the City Engineer. All sanitary sewer system improvements shall be constructed in accordance with City plans, ordinances, resolutions, policies and the Standard Specifications of the Public Works Department. The subdivider is required to construct sewer main extensions to serve the parcel map in a manner determined by the City Engineer. The connection to the City's sanitary sewer system requires the payment of all applicable sewer connection charges in accordance with the provisions of FMC Chapter 9, Article 5 prior to the approval of the map. D. WATER SYSTEM. The subdivider shall connect each parcel being created to the City of Fresno's water system with a separate water services and meters unless other arrangements are approved by the City Engineer. All water system improvements shall be constructed "in accordance with City plans, ordinances, resolutions, policies and the Standard Specifications of the Public Works Department. The subdivider is,required to construct water main extensions to serve the parcel map in a manner determined by the City Engineer. The connection to the City's sanitary sewer system requires the payment of all applicable water connection charges in accordance with the provisions of FMC Chapter 14, Article 1 prior to the approval of the map E. STREET, SEWER AND WATER CONSTRUCTION PLANS. The subdivider shall provide street, sewer and water construction plans for the required public improvements as determined by the City Engineer. Such plans shall be prepared by a registered Civil Engineer and approved by the City Engineer prior to the issuance of Street Work permits. F. CONSTRUCTION/DEFERRAL. The subdivider shall construct the street, sanitary sewer system and water system improvements required for this parcel map, and the work deemed completed by acceptance of the work by the City Engineer, prior to the approval and recordation of the Parcel Map. Conditions of Approval Tentative Parcel Map No. 2000-10 Page 8 August 13, 2002 Alternatively, the subdivider may request the deferral of the construction of such improvements with a parcel map agreement. The City Engineer may approve such agreement wherein the subdivider will be required to provide an Engineer's Estimate of the work. The agreement will be prepared by the City and will require performance securities as determined by the City Engineer. VIII. Development Fees Industrial Development Incentives (Informational Only) The City Council on June 17, 1997 adopted Ordinance No. 97-29 (effective July 28, 1997) establishing Section 12, Article15 of the Fresno Municipal Code to provide the following development incentives for parcels zoned M-1, M-2, M-3 or M-1-P: Impact Fee Reduction. Provides for the reduction of the number of units for sewer and water connection charges for low flow users as determined by the Director of the Public Utilities Department, based on certified estimates, the City Engineer's opinion and an agreement with the City. Impact Fee Waiver. Waives the Trunk Sewer and Major Facilities Trunk Sewer fees for projects within the trunk sewer service areas for Herndon, Cornelia and Fowler. Impact Fee Deferral. Provides for the deferral of the payment of various sewer and water connection charges, and UGM fees to the time of occupancy under an agreement with the City. Impact Fee Financing. Provides for the financing of the sewer Wastewater Facilities Charge over a 5 year period under an agreement with the city. Public Improvement Deferral. Provides for the deferral of certain public infra- structure improvements, by agreement, if the appropriate findings are made by the Public Works Director. All fees noted in this section shall be due and payable to the City of Fresno prior to Conditions of Approval Tentative Parcel Map No. 2000-10 Page 9 August 13, 2002 the approval of the final parcel map. The Federal Clean Water Act and the State General Permits for Storm Water Discharges Associated with Construction and Industrial Activities (State General Permits) require M4 developers of construction projects disturbing five or more acres, and discharges associated with industrial activity not otherwise exempt from National Pollutant Discharge Elimination System (NPDES) permitting, to implement controls to reduce pollutants, prohibit the discharge of waters other than storm water to the municipal storm drain system, and meet water quality standards. These requirements apply both to pollutants generated during construction, and to those which may be generated by operations at the development after construction. a. State General Permit for Storm Water Discharges Associated with Construction Activities, August 1999 (available at the District Office.) A State General Construction Permit is required for all clearing, grading, and disturbances to the ground that result in soil disturbance of at least five acres (or less than five acres if part of a larger common plan of development or sale). Permittees are required to: submit a Notice of Intent to be covered and must pay a permit fee to the State Water Resources Control Board (State Board), develop and implement a storm water pollution prevention plan, eliminate non-storm water discharges, conduct routine site inspections, train employees in permit compliance, and complete an annual certification of compliance. Under the Phase II federal storm water quality regulations a State General Construction Storm Water Permit will be required for all activities that disturb one acre no later than November, 2003. b. State General Permit for Storm Water Discharges Associated with Industrial O Activities, April, 1997 (available at the District Office.) A State General ■ Industrial Permit is required for specific types of industries described in the NPDES regulations or by Standard Industrial Classification (SIC) code. The following categories of industries are generally required to secure an industrial permit: manufacturing; trucking; recycling; and waste and hazardous waste O management. Specific exemptions exist for manufacturing activities which occur entirely indoors. The drainage system cost and fee obligation indicated in this notice is the obligation which is valid at the date of this notice. Contact the District for a final drainage fee obligation prior to recording of the final map. Pursuant to the ordinance code, the drainage fee identified on the cover page of this notice is the estimated cost of facilities required by Paragraph No. 2 of said notice. The Developer may construct the"Optional Master Plan Facilities", identified on Exhibit No. 1,to provide permanent drainage service for the portion of the site draining to Herndon Avenue. If the optional facilities are not constructed,the District recommends temporary facilities until permanent service is available. The cost of construction of Master Plan facilities,excluding dedication of storm drainage easements, is eligible for credit against the drainage fee of the drainage area served by the facilities. A Development Agreement shall be executed with the District to effect such credit. Reimbursement provisions, in accordance with the Drainage Fee Ordinance, will be included to the extent that Developer's Master Plan costs for an individual drainage area exceed the fee of said area. Should the facilities cost for such individual area total less than the fee of said area, the difference shall be paid upon demand to the City or District. The following paragraphs only apply towards development of the individual parcels and are not conditions for the recording of the map: In an effort to improve storm water runoff quality,outdoor storage areas shall be constructed and maintained such that material which generates contaminants will not be conveyed by runoff into the storm drain system. District encourages,but does not require that roof drains from non-residential development be constructed such that they are directed onto and through a landscaped grassy swale area to filter out pollutants from roof runoff. Runoff from areas where industrial activities, product, or merchandise come into contact with and may contaminate storm water must be directed through landscaped areas or otherwise treated before discharging it off-site or into a storm drain. Roofs covering such areas are recommended. Cleaning of such areas by sweeping instead of washing is to be required unless such wash water can be directed to the sanitary sewer system. Storm drains receiving untreated runoff from such areas that directly connect to the District's system will not be permitted. Loading docks,depressed areas, and areas servicing or fueling vehicles are specifically subject to these requirements. This pipeline was installed in 1959 within the public road (James Avenue) by virtue of franchise rights with Fresno County, PG&E requests that this facility be delineated on the final map. I have attached a copy of our gas plat showing the approximate location of the pipeline, General Order No. 112E of the California public Utilities Commission eats forth cortain requirements for the construction and operation of underground gas lines. Any proposed development plans should provide for unrestricted utility access and prevent encroachments that might impair the safe and reliable maintenance and operation of PC&E's facility.
