Section 2 Except as authorized no member shall contact the office of the City Manager, another City department, governmental entity, or official agency on any matter affecting the Department or any employee thereof, except through regular channels or in cases where routine business of the Department requires. Section 3 No information relative to investigations, operations, or the business affairs of the Department shall be furnished to persons not connected therewith, except as authorized by the Fire Chief. Section 4 No member shall, on or off duty, use the uniform, badge, or prestige of the Department for the purpose of personal gain. Section 5 Members shall not use their name, their affiliation with, and/or the prestige of the Department to endorse any commercial or business enterprise, without prior written consent from the Fire Chief. Section 7 No member shall directly or indirectly intercede with a member of the Civil Service Board on behalf of any member whose hearing is pending or being heard, except as provided by laws and ordinances. Section 8 No member shall directly or indirectly solicit the influence or intercession of any person or persons to affect his/her transfer or promotion. Section 9 Members shall not solicit or accept the personal or financial aid of any subordinate to promote their private interest or those of any superior officer. Section 10 No member shall, while either on or off duty, purchase, possess, furnish, use or consume any illegal drugs. Note: An illegal drug is any controlled substance, as defined by State or federal law, which has not been obtained in accordance with the regulations promulgated to administer its distribution or any drug that has not been assigned an FDA number. Section 11 Members shall not render themselves unfit to fully perform their duty by use of drugs or alcohol. a. An over -the-counter drug is any drug lawfully available for retail purchase without a prescription. b. Mem bers shall not possess or cause to be brought into quarters or into adjacent premises and intoxicating alcohol. c. Non-alcoholic beer and/or wine cannot be purchased, possessed, or consumed by any on-duty member. Section 12 Members will not be a party to any malicious gossip, report, or activity that would tend to disrupt Department morale or bring discredit to the Department or any member. Section 13 Members will not use obscene, uncivil, or boisterous language while on duty, in uniform, or at any Department sponsored or assigned activity. Fighting under any circumstances is prohibited. Section 14 The falsification of records or the making of misleading entries or statements with intent to deceive or the willful mutilation of any useful Department record, book, paper, or document will be considered a serious offense. Section 15 Use of tobacco products by members in uniform will not be permitted. Section 18 Members will not gamble while on duty. Section 19 Members will secure permission and then submit a written request to authorize another person to receive their paycheck. Section 20 Punctuality is required of all members. Failure to report for duty or place of assignment at the time specified will be considered cause for disciplinary action. Tardiness shall be reported immediately to the appropriate superior officer. Section 21 Inefficiency or indifference of members in the performance of their duties will be sufficient cause for disciplinary action. Section 22 Members will not willfully disobey any lawful order issued by a superior officer, or speak disrespectfully of, or to, any superior officer. All are cause for disciplinary action. Section 25 An acceptable degree of privacy shall be provided to all members. Employees shall not infringe upon the right to privacy of other members. Section 26 No member shall possess, view, or display offensive sexually graphic materials such as, but not limited, books, magazines, periodicals, films, and video tapes while on City property or while on fire apparatus. Section 27 No member shall discriminate against another member based on race, color, ancestry, national origin, gender, religion, disability, medical condition, marital status, sexual orientation, sage, disabled veteran status, or status as a veteran of the Vietnam era, or any other classification protected by law. This Department policy is in compliance with City of Fresno Administrative Order Manual. Section 28 Horseplay, including practical jokes that cause injury or damage to equipment, property or person is strictly prohibited.
