SECTION 109.003 FIRE CHIEF
FIRE CHIEF
Section 1
The Fire Chief is the Chief Executive Officer of the Department; shall have direct
control, management, and direction of all members of the Department, with authority
to detail any of them to such public service as necessary, with the approval of the City
Manager, subject to and in such manner as provided by the Charter and Ordinances
of the City of Fresno.
Section 2
Shall have the authority to organize, manage, and control the various divisions,
sections, committees, etc., which is his/her judgment may be for the best interest of
the service, all subject to and in such manner as provided by Charter and Ordinances
of the City of Fresno.
Section 3
Shall have the authority to establish suitable measures to put into effect the policies,
rules and regulations, practices, and procedures necessary for the efficient operation
of the Department.
Section 4
Shall recommend to the City Manager, as deemed necessary, the selection of new
sites; changes in location of fire stations and companies; the building of new fire
stations; the purchases of new apparatus, equipment, appliances, materials, etc.; the
sale of surplus and obsolete equipment not necessary for use in the operations and
maintenance of the Department; and the reason for such action and shall prepare and
present to the City Manager an annual budget adequate to operation the Department.
Section 5
Shall report to the City Manager any officer or member who, by reason of disease,
accident, or other incompetency, does not or cannot fully and promptly perform the

duties required; shall report any unusual matters that may develop in connection with
the operation of the Department.
Section 6
Shall report to the City Manager whether the services of probationary members are
satisfactory or unsatisfactory.
Section 7
Shall cause to be kept in proper form an accurate record of all business transacted by
the Department.
Section 8
May reprimand, demote, fine, suspend without pay, or remove from the service for
cause any member of the Department in such manner as is provided by the Charter
and Ordinances of the City of Fresno, the Standard Operating Procedures,
Administrative Manual, and/or its amendments, and any other Department policy or
practice either temporary or permanent, deemed as necessary by the Fire Chief.
Section 9
May grant leaves of absence to members of the Department in such manner as
provided by the Charter and Ordinances of the City of Fresno.
Section 10
Shall cause all injurious or dangerous fires to be extinguished with the least possible
danger to life and property and prevent unnecessary damage at fires by use of water
or other extinguishing agents and equipment.
Section 11
Shall have authority, in the event of fire or other emergencies, to demolish buildings
and parts of buildings that, in his/her judgment, might endanger life or cause further
damage to property.

Section 12
Shall have authority, during a conflagration or other extraordinary emergency, to
temporarily suspend the operation of the platoon system and recall the off duty
personnel to service.
Section 13
May provide the most expedient service and equipment possible to provide
emergency medical care to the extent required by the City Council.
Section 14
May call a meeting of the chief officers, and all chief officers are to be present unless
excused.
Section 15
Nothing contained in these Rules and Regulations is to be construed to limit the power
and authority granted the Fire Chief by the City Charter or superior status (state and
federal laws), in the operations of extinguishing any fire and taking the necessary
precautions to prevent the spread thereof.
Section 16
Shall make such inspections, observations, and investigations as may be necessary
in order to be thoroughly familiar with conditions of the service.
