Johnson, Senior Administrative Clerk Section 107.001 Page 1 of 3 PURPOSE To assist a supervisor in the proper grievance procedure. APPLICATION A grievance is a dispute concerning the interpretation or application of any existing City rule or regulation governing personnel practices or working conditions, including the current Memorandum of Understanding (MOU). OPERATIONAL POLICY Upon receipt of a formal grievance on the proper form, the immediate supervisor will determine if all technical conditions of the grievance procedure to this point have been met. 1. The grievant has met informally with the immediate supervisor to discuss the grievance prior to filing. 2. Grievance was filed within the specified number of days from the time the member becomes aware or should have been aware of the issue or incident. Copy of the grievance form must be sent to the labor relations division within the specified number of days. 3. The grievance involves a cla imed misapplication or misinterpretation of a rule or regulation relating to an existing right or duty. 4. The member is not seeking resolution through another established procedure, i.e., Civil Service Board, Retirement Board, or unfair employer-employee relations charge fact-finding procedure. Section 107.001 Page 2 of 3 The immediate supervisor will review the completed form with the grievant at the time of receipt to ensure: 1. The completeness of the grievance form. 2. The facts are clearly understood. 3. The stated rule or regulation claimed to have been violated has been indicated. The immediate supervisor will evaluate the remedy sought by the grievant and prepare a written response. Prior to returning the response to the member, the immediate supervisor will meet with the respective battalion chief and/or appropriate deputy chief to discuss the draft response. The written response will then be returned to the grievant within the specified number of days to the immediate supervisor’s receipt of the grievance. Note: For the steps listed above, refer to the current MOU of the grievant. OPERATIONAL GUIDELINE This section intentionally left blank.
