100 Administrative Manual
SECTION 101.002 CONSTANT STAFFING POLICY
PURPOSE
The purpose of this document is to establish responsibilities and procedures for the
minimum daily staffing of the Field Operations Division members for the Fresno Fire
Department (FFD or Department).
APPLICATION
This document applies to all members of Unit 5 (IAFF Local 202) and details the
administration of work schedules; relief pools, shift trades, leave usage, accumulation,
and shift replacement hiring.
OPERATIONAL POLICY
It is Department policy for an on-duty battalion chief to ensure daily staffing
assignments of the Operations Division members are completed in a timely and
effective manner each day.
In conjunction with the Labor-Management Alliance guiding principles, a committee of
four (4) members, two (2) selected from Fire Administration and two (2) selected by
IAFF Local 202, will convene as needed to adjust this policy.
Relief Pool Staffing Levels:
The following table reflects the relief pool range:

The Fire Chief will have discretion to set evenly distributed relief pool numbers within
these ranges; however, adjustments of the relief pool outside these ranges will require
mutual agreement between the Fire Chief and IAFF Local 202.
Fire Administration will have up to six (6) months to replenish the relief pool staffing
levels to within the range. If the six (6) month time frame is exceeded, the mandatory
hiring for all ranks will be discontinued.
The following table titled, Table 2: Stratification of Ranks, will be used to determine
staffing level distribution. In the absence of a promotional list, the Department should
fill vacancies with provisional appointments. Mandatory assignments for the ranks of
captain and firefighter specialist will cease if the staffing falls outside the table
parameters for greater than 60 days, while operating within the agreed range.

Daily Staffing:
On-duty battalion chiefs will use computerized staffing program to assist in the daily
staffing assignments of apparatus and personnel.
Factors that affect daily staffing include:
• Shift Trade
• Sick Leave
• Vacation and Holiday Leave
• Compensatory Time Off
• Acting
• Shift Replacement Hiring
• Mandatory Hiring
• Recalls and Hold Over of Members
Shift Trade:
With the approval of the Fire Chief, or designee, a member assigned to a twenty-four
(24) hour shift may attend to union or other personal matters by providing an off-duty
member of like rank to work for the absent member. The act of providing for a shift
trade replacement is referred to as “Shift Trade”, also known as “Absence with Relief”
(AWR).
When approved, shift trades may be taken in any time increment. The City of Fresno
(City) will incur no additional liability due to the use of shift trades or assume any
responsibility regarding pay back of such time.
Members requesting a shift trade will enter the appropriate work code into the
department staffing program and designate the member who will be their replacement.
It will be the duty of the member requesting the shift trade to arrange for replacement,
secure required approval, and ensure the required work codes are entered no less than
ten (10) hours in advance of the requested absence.
The ten (10) hour notice may be waived with approval of the Fire Chief or designee.
Chief officers will not approve a shift trade request submitted for the purpose of other
employment, including self-employment. All outside employment while on shift
trade is forbidden.
The denial of a shift trade request will not be unreasonable or capricious. A chief officer
who denies a shift trade request will notify the member of the reason for denial.

A substitute member becoming ill and who is unable to fulfill their shift trade obligation
shall make a diligent attempt to secure their own replacement with a shift trade. If
unable to secure a replacement, a substitute member becoming ill is eligible to use
earned sick leave.
Holiday (UH), Compensatory (CTO), and Vacation (V) leave may be utilized to satisfy
shift trade obligations; in this case, members must find their own replacements.
A member's shift trade privilege may be revoked by order of the Fire Chief as a form
of corrective action consistent with the provisions of the Memorandum of
Understanding (MOU) and Fresno Municipal Code (FMC). The revocation of shift
trades may be appealed to the Civil Service Board under the provisions of FMC,
Section 3-284, Appeal Procedure, and Disciplinary Matters. If appealed, the
revocation of shift trade privileges will be stayed until a decision is rendered by the
Civil Service Board. The decision of the Civil Service Board shall be binding on both
parties.
Once a Shift Trade has been entered into the staffing software program, it may not be
cancelled or modified unless both parties mutually agree and/or except in cases where
departmental operational needs as identified and outlined in this policy.
Captains assigned to an acting position to fill an extended-period vacancy in the
battalion chief rank may exchange shift trades with a battalion chief. Battalion chiefs
will not work back shift trades in a captain's position.
Sick Leave Procedures/Requirements:
Sick leave will be administered in accordance with the provisions of the MOU, FMC,
Section 3-107, Sick Leave; Administrative Order No. 2-20, Sick Leave Policy; and
provisions contained within this procedure.
Sick Leave Notification Requirements:
Any 56-hour member who is unable to report to duty due to illness or injury should
enter the absence prior to 0600 hours. After 0600 hours, telephone contact with a
battalion chief is mandatory and must be made prior to 0800 hours.
Use of sick leave by 40-hour members should be requested and approved by the
employee’s supervisor prior to the usage of leave.
Any member who fails to make proper notice of inability to report to duty prior to 0800
hours will be denied the use of sick leave for the assigned workday or shift and will be
placed on leave without pay (LWOP) status. An exception to this policy will be made

if the Fire Chief determines reasonable circumstances existed to prevent the member
from fulfilling this requirement.
Vacation, Holiday (UH), and Compensatory Time Off (CTO) Leaves:
The administration of annual vacation and holiday leaves are in conformance with the
FMC, Sections 3-108 to 3-116, and applicable provisions in the MOU (Unit 5).
Uncovered leave requests will not be approved until completion of the vacation draw
for the corresponding year. The total uncovered Vacation, UH and CTO full shifts are
limited to five (5) employees off per rank, per day for a total of fifteen (15) employees.
Members cannot use uncovered leave without obtaining a relief on any day mutually
agreed to by Fire Administration and Local 202 listed below. This agreement must be
made at least thirty (30) days in advance.

Vacation Draw:
Procedures for the vacation draw will be posted on a special notice prior to
implementing the vacation draw.
Members may draw vacation in twenty-four (24) hour increments not to exceed their
annual accrued balance. The maximum number of members allowed to draw vacation
per day will not exceed three (3) captains, three (3) engineers, and three (3) firefighters.
Following the completion of the vacation draw, members may opt to cancel their
scheduled and unscheduled vacation leave days. Requests must be submitted at least
seven (7) calendar days in advance to their respective battalion chief.

Vacation, Holiday (UH) and Compensatory Time Off (CTO) Leave
Procedures/Requirements:
Use of Vacation, UH and CTO leave by 40-hour members should be requested and
approved by the employee’s supervisor prior to the usage of leave.
Members wishing to use Vacation, UH or CTO leave may use it in one (1) to twenty-
four (24) hour shift increments. Members are not allowed to work leave replacement
while on Vacation, UH or CTO.
Members may not work overtime/shift replacement except for mandatory holdovers
and/or mandatory recalls while on Vacation leave.
Members must find coverage for any partial shift leave request.
Requests for Vacation, UH and CTO leave should be entered not less than ten (10)
hours in advance of the requested absence. The ten (10) hour notice may be waived
with approval of the Fire Chief or designee. It will be the replacement’s responsibility
to work the agreed upon period.
Once a Vacation, Holiday, or CTO leave with replacement has been entered into the
staffing software program, it may not be cancelled or modified unless both parties
mutually agree and/or except in cases where departmental operational needs as
identified and outlined in this policy.
Accrual of CTO by 56-Hour Members:
Employees assigned to a fifty-six (56) hour work week who work a compensatory time
replacement (CTR) shall only accrue CTO, up to one hundred forty-four (144) hours
per fiscal year. Accrual of CTO is not allowed while working a UH, or UV leave
replacement.
Members may opt to split an OT/SR to accrue CTO in any increments. Requests must
be made to their respective battalion chief prior to 2000 hours. Logging of the SR hours
will apply to sum of hours worked.
At the Department’s discretion, when there are excess members on duty, a member
working UHR, CTR, or UVR may be relieved from their obligation to work. The
following guidelines will be used when utilizing members committed to UHR, CTR, or
UVR:
1. UHR/CTR/UVR will have priority on the roster over SR/OT should
over hiring occur.

2. When determining priority for partial vacancies, the UHR/CTR/UVR
start time must be prior to the vacancy start time.
3. Members committed to a UHR/CTR/UVR should be placed on the
roster prior to 0645 hours the day of the commitment if the vacancy
permits. Notification by the battalion chief is not required when this
timeframe is met. When a member committed to a UHR/CTR/UVR
is placed into a vacancy after 0645 hours, the member will be
notified. The member will be allowed two (2) hours to arrive at the
assignment.
4. UHR/CTR/UVR not utilized to fill a vacancy will remain committed to
fill a vacancy until 0800 hours. Any subsequent vacancies after 0800
hours will be hired from the hiring list.
Union Time Off:
Union Time Off (UTO) requests for Association Executive Board members will be made
directly to the staffing officer.
Acting:
The Department utilizes actors to maintain staffing of apparatus. Actors will not be
used unless they are qualified for the position, they are filling. The process for
qualification is described in Administrative Manual, Section 101.004, Acting Policy.
Acting will only occur under the following circumstances:
• When the Department is unsuccessful in filling a vacancy according
to established shift replacement hiring procedures including the
mandatory hiring process.
• As a substitute for a member who has been hired according to the
mandatory hiring procedures in this policy.
• To assist staffing apparatus during a recall of members.
• To temporarily keep a company in service due to a member illness,
injury, or doctor’s appointment.
• To temporarily keep a company in service due to vacancies caused
by emergency response (e.g., out of county response, regional OES
incidents, etc.).

• To temporarily keep a company in service due to training, meetings,
interviews, or other Department activities.
The Fire Chief retains the discretion to assign an actor for a battalion chief vacancy
when it is deemed necessary to maintain continuity of command and/or in the best
interest of the Department.
Shift Replacement Hiring:
Voluntary hiring, as described in this policy, will be used to maintain daily staffing levels
for the twenty-four (24) hour duty stations below the rank of battalion chief. Nothing
contained herein shall be construed as limiting the Fire Chief’s ability to recall members
in the event of any catastrophic event or major emergency.
Minimum staffing levels refer to the number of members per unit, as determined by the
Fire Chief. If there are insufficient on-duty members available, attempts will be made
to fill any vacancies projected for a period of more than two (2) hours by shift
replacement.
Members may compete for shift replacements while on UH, and CTO; however, they
must compete for the vacancy through the hiring list.
Members on sick leave, injury leave, leave without pay, light duty, or who have optioned
out of this policy shall not be eligible to work leave or shift replacement.
Guidelines for Shift Replacement Hiring:
Every attempt will be made to evenly apportion the opportunity for members to work
shift replacement. Therefore, leave and shift replacement hours will be logged. These
hours will be logged as outlined in the section on incentives. The total of logged hours
worked shall be used as a primary determinant when hiring shift replacements. Logged
hours will be reset to zero on July 1 each year.
Firefighter trainees who are promoted to firefighters after July 1 of any year will be
credited the average number of shift replacement hours worked by all firefighters at the
time of their promotion. These hours will be used when being considered for shift
replacement.
Members who desire to work shift replacement, special events, strike team and
overhead assignments will put themselves on the respective sign-up lists. Only those
names on the respective sign-up lists will be considered for any given day. The names
of members will remain on the list until the given day has passed, unless removed from
the list by the member prior to being hired.

Once the automated hiring process has been completed, SR, UHR, CTR, UVR, STW
and Vacation Relief assignments can be altered by mutual agreement of both parties.
All requests will be made to the Staffing Officer.
Members must decline the offer to be hired if they cannot arrive at the assignment
station within two (2) hours or less. The intent is to fill the vacancy as quickly as
possible within the hiring policy to not close an apparatus and relocate members.
If the member cannot work an assigned shift, they must contact the staffing officer and
request to be removed from the assignment. All accepted hours will remain logged.
An exception to this rule will be granted in cases where an on-the-job injury has
occurred or bereavement leave would apply as defined in the MOU for Unit 5 (Article
VII, H, 3, c).
If a shift replacement assignment is altered, the member may decline to work the
assignment without incurring a penalty.
Hiring will be conducted during the following time periods:
1. 1000 hours: All projected vacancies will be hired up to 6 days out.
Members will have a twenty (20) minute wait time.
2. 1600 hours: All projected vacancies will be hired up to two (2) days
out, including mandatories. Members will have a five (5) minute wait
time.
3. 0600 hours: All projected vacancies will be hired for the current day,
including mandatories. Members will have a two (2) minute wait
time.
4. Vacancies arising during a shift (i.e., after 0800 hours) will be hired
immediately, including mandatories. Members will have a two (2)
minute wait time.
Holidays or special activities may create excess full and partial shift vacancies which
may be hired at an identified time prior to the vacancy. Mandatory hiring may take
place after hiring has been completed. Members will be assigned and notified of their
mandatory assignment. Members needing to use an exemption will need to call the
Staffing Officer. Positive contact from the Staffing Officer will be made prior to the shift
start time. The date of the voluntary hiring and mandatory hiring will be agreed upon
by the Constant Staffing Committee and published in a special notice as early as
possible.

Eligibility for Shift Replacement Hiring:
To determine a member’s eligibility for shift replacement, consideration will be given to
the following criteria in the order listed:
1. Rank.
2. Lowest total logged hours worked.
3. Specialty or safety officer qualification.
4. Seniority in rank.
Staffing Procedures:
The following sections describe the steps in sequence that the staffing officer should
follow when attempting to fill vacancies.
Daily, prior to the start of automated hiring, the following steps in sequence are
implemented:
1. Utilize excess and/or relief pool members.
a. Place rank for rank.
b. Prioritize placement to specialty team vacancies or safety
officer vacancies if qualified.
c. Leave unassigned rather than place into a position out of rank.
d. Non-specialty relief member should be placed in specialty
positions if specialty staffing minimums have been met.
2. Utilize qualified members to fill specialty team or safety officer
vacancies if specialty staffing minimums have not been met.
a. Place rank for rank.
b. Place qualified members who are working
STW/UHR/CTR/UVR/SR.
c. Place qualified regular duty members who are not assigned
to a specialty station or safety officer position.

d. ARFF qualified members at Station 10 will be moved to
vacancies at AR1/AR2.
3. Automated hiring will run at 1000 hours.
a. If specialty or safety officer qualifications are needed to
maintain minimum specialty team or safety officer
requirements, hiring will be adjusted two (2) days out during
the 1600 hours hiring period to meet the needs of the
Department.
b. Any relief member with no vacancy in rank will be utilized as
extra staffing.
Mandatory hiring is utilized after the previous steps have been implemented according
to the following rules:
1. Vacancies are filled on a rank for rank basis.
2. Vacancies requiring a specialty team or safety officer qualification to
maintain minimum team or safety officer requirements are filled with
qualified members.
3. If vacancies exist after exhausting an entire rank’s mandatory list,
qualified members may be hired from the hiring list prior to using the
mandatory list of qualified members of other ranks.
4. If a specialty or safety officer position is unable to be filled by
mandatory hiring, move a regular duty dual-qualified specialty team
member to another team or regular duty dual-qualified safety officer
to the safety officer position to maintain minimum specialty team or
safety officer requirements.
Should additional vacancies occur after the roster has been completed, the previously
assigned actors and/or members assigned to work in lower ranks hired to cover a
mandatory assignment for another member should remain in their assigned positions.
When moving specialty or safety officer qualified personnel according to the hiring
procedures above, the staffing officer will place members who are on SR first, and then
UHR/CTR/UVR/STW, in reverse seniority order. Qualified senior members may
request assignment to the specialty station or safety officer position if it can be
completed prior to the start of the shift.

Over Hiring:
In the event excess members have been hired, the Department may relieve a member
from their obligation to work. The removal of SR will only occur if it is rank for rank.
The determination of what member will be relieved of the obligation to work will be
made according to the following criteria in the order listed:
1. Operational needs of the Department.
2. Rank.
3. Highest logged hours.
a. UHR/CTR/UVR will have priority on the roster over SR should
over hiring occur.
b. SR will have priority on the roster over MSR should over hiring
occur.
4. Lowest seniority (tiebreaker).
Mandatory Hiring:
To ensure complete staffing of all resources, the Department reserves the right to
mandate members to work.
A mandatory staffing list will be kept for captains, firefighter specialists, and firefighters.
Members with the most recent date of mandated occurrences will be placed at the
bottom of the mandatory staffing list. Members with no occurrences will be placed at
the top of the list in reverse seniority order, followed by members with the oldest date
of a mandated occurrence.
Prior to filling vacancies using the mandatory list, contact using the Department staffing
program will be made to all members of that rank. Members that call in and are
awarded to work the vacancy will be credited for a mandatory worked.
If vacancies still exist, mandatory assignments will be initiated by the staffing officer
beginning at 1600 hours two (2) days before the shift. Priority will be given to members
who are working their regular shift assignments (i.e., regular duty). These members
will be contacted following the order of their placement on the mandatory hiring list. If
vacancies remain after assigning all regular duty members, the remaining members on
the mandatory hiring list will be contacted following the order of the list.

Once contacted and assigned, members are required to fill the vacancies.
Members who are working mandatory assignments may trade with other members
working mandatory assignments by mutual agreement.
In order to receive credit for a mandatory assignment, the member is required to either
complete the assignment themselves or find a replacement (for either full or partial
shifts) to fulfill the assignment. The replacement will be entered and recorded as shift
replacement, and hours logged accordingly. Only the member initially hired and
assigned to the mandatory shift will receive credit for the mandatory assignment.
Members who cancel a Shift Replacement within 48 hours and are mandated to work
that shift due to mandatory hiring will not receive mandatory credit.
Members may find a replacement of like rank or a qualified actor from another rank. If
the member hired to work a mandatory assignment finds a replacement, the member
is released from any mandatory assignment for the current twenty-four (24) hour shift.
Members may be exempt from mandatory staffing for the following reasons:
• Leave code entered into staffing program
• Medical Reasons supported by a doctor’s note
• Child-care Situations
• Pre-arranged Vacation Plans
• Pre-scheduled Executive Board activities
• Pre-scheduled Events mutually agreed upon by the Fire Chief and
Local 202 President or their designee .
Logged hours will be received for members who are mandated while on Regular Duty
or are mandated for holidays or special activities and use an exemption for Childcare
or Pre-arranged Vacation Plans.
If, in the opinion of a battalion chief, a member is fatigued or impaired either mentally
or physically and cannot safely perform their duty, the member will not be mandated to
work.
WRT, HMRT, US&R, ARFF, Investigator or safety officer qualified members may be
mandated to work to maintain staffing levels on the respective specialty teams or safety
officer positions.
A member may exercise an option to not be mandated for one (1) year. The option to
opt out or in the mandatory policy will occur on the date of the zeroing of logged hours.
If a member opts to not be mandated, the member may not volunteer to work any leave
or shift replacement for one (1) year. The member may be recalled or held over while
on an emergency call.

Members will not work mandatory assignments on consecutive days.
Logging of Hours:
The logging of hours will apply to all hiring used to fill vacancies for firefighting activities,
i.e., roster vacancies, strike teams, and up staffing of apparatus for special events.
No hours will be logged for the following situations:
1. Vacancies worked for firefighting activities of ten (10) hours or less.
If a member works in the same station more than ten (10) hours in a
twenty-four (24) hour shift all the hours will be added to their bucket.
2. Recalls and hold overs.
3. Working a mandatory assignment.
4. Vacancies worked for firefighting activities on:
• New Year’s Day
• Easter Sunday
• Independence Day
• Halloween
• Thanksgiving Day
• Day after Thanksgiving
• Christmas Eve
• Christmas Day
• New Year’s Eve
5. Off-roster hiring, i.e., committee meetings, specialty team meetings,
and training classes.
Relief from Duty:
At the change of shift (0800 hours), a member shall not go off duty until relieved by
another member assigned to perform similar duties. If no relief has been provided, the
member may be required to remain on duty for up to thirty (30) minutes (0830 hours).
After all members of an oncoming company have signed on duty, the company officer
may release from duty the members without a scheduled relief in accordance with Unit
5 MOU Article VII K, Relief. An individual member may leave after they have been
specifically relieved. All members are encouraged to stay over to fill vacant positions.
Any exceptions must be approved by a battalion chief.

During the shift, a member shall not leave their duty assignment until replaced by a
qualified relief. Any exceptions must be approved by a company officer who will notify
the battalion chief. Exceptions may include, but are not limited to, a member needing
to use emergency leave, sick leave, family sick leave, or sustaining an injury and
needing to be replaced.
Emergency leave may be allowed for an employee to attend to an emergent situation
that requires the member’s immediate attention for up to two hours. If the employee
cannot return to duty within two (2) hours an appropriate leave code will be utilized for
the duration of the absence.
Temporary Reduction of Staffing to Two Members:
Staffing may be temporarily reduced to two (2) members for up to two (2) hours
provided one of the members is a qualified captain and the other is a qualified engineer
with approval of an on-duty battalion chief. This is to be used when there are

Recalls and Hold Over of Members:
Recall of members will be made in accordance with Standard Operating Procedures
Manual, Section 204.006, Procedures for Recalling Off-Duty Members.
Members who are held over for more than two (2) hours or who are recalled will receive
credit for a mandatory occurrence.
Staffing System Failures:
In the event the staffing system is not functioning, the battalion chief will make every
attempt to hire within the confines of these guidelines.
