B. At the time of development of the Subject Property, an applicant may be required
to provide additional dedication for public easements (e.g. for purposed of public
streets, utilities, pedestrian ways, trails, bike paths, etc.) and the construction of
additional public improvements as conditions for the approval of development
entitlements and the payment of applicable sewer connection charges, water
connection charges and applicable development impact fees.
C. Compliance with the requirements of a certificate of compliance shall not

SUBJECT: BOND DEPOSIT REQUIRED TO MAKE R-93-35 EFFECTIVE -QUICKIE
DESIGNS INC. 2842 NORTH BUSINESS PARK AVENUE.
The final element required to cause rezoning R-93-35 to become
effective is the installation of the required street improvements
or the provision of an agreement and security for those
improvements. The City of Fresno has agreed to execute a
Development and Capital Equipment Acquisition Agreement that will
provide incentives to Quickie Designs Inc. in the form of payment
of fees on behalf of Quickie Designs Inc. The fees will be pain as
per a schedule of payments in accordance with a time schedule
within the agreement.
The agreement provides for a fee incentive of a maximum of $100,000
to be paid during Fiscal Year 1994. An additional $70,500 will, be
provided in subsequent years under the conditions of the agreement.
The remaining funds to be provided as incentives are more than
ample to meet the required bond for street improvements of $7,400.
The funds will be used as security for those improvements required
by rezoning No. R-93-35. All required dedications have been made to
the satisfaction of the City of Fresno.
In that all of the conditions of section 3 of Ordinance No. 93-75
have been satisfied, rezoning No. R-93-35 is hereby deemed to be
effective.

SUBJECT: FINAL ACTION BY THE FRESNO CITY COUNCIL
REGARDING REZONING APPLICATION NO. R-93-35
LOCATED ON THE WEST SIDE OF NORTH FOWLER AVENUE
SOUTH OF EAST SHIELDS AVENUE
The Council at its regular meeting on December 7, 1993, adopted
Ordinance No. 93-75 (enclosed) which will rezone the above
described property from AE-5/UGM to M-1/UGM subject to satisfying
the requirements of Section 12-404-1 and K of the Fresno Municipal
Code (FMC) as listed below.
In order for the M-1/UGM zoning to become effective, you must
complete each of the following requirements within the time
allotted.
A. Section No. 3 of Ordinance No. 93-75 identifies that there is
a requirement for the dedication of right-of-way for public
street purposes.
An offer of dedication must be submitted no later than
60 days following Council approval of the rezoning
application. There is a provision of the Code that permits
the Director to grant a 30 day extension of that time limit.
There is a fee of $460.00 (or most current fee in effect) to
process a request for an extension of time. This fee must be
paid within 60 days of Council approval in order to grant an
extension of time.

IF AN OFFER OF DEDICATION IS NOT RECEIVED WITHIN 60 DAYS (OR
90 DAYS WITH AN APPROVED EXTENSION) OF COUNCIL APPROVAL, THE
ZONING GRANTED BY COUNCIL WILL EXPIRE.
B. Section 3 of Ordinance No. 93-75 identifies that street
improvements are required as conditions of zoning approval.
(Please refer to enclosed ordinance.)
The code states that the required off -site improvements are
to be installed and accepted by the Public Works Director
within two years of Council approval of the rezoning
application.
If you are unable to install the required improvements within
the prescribed two years, you may request a two-year
extension. However, you must enter into an agreement with
the City of Fresno agreeing to install the required off -site
improvements. Furthermore, you must post financial security
such as cash, bond, or other as approved by the City Attorney.
This agreement, in a form approved by the City Attorney,
shall be submitted to the Director no later than 30 days
before the expiration of the original two-year time limit
described above. You should also file, concurrently, a
request for a two-year extension. There is a fee of $690.00
(or most current fee in effect) for the processing of an
extension of time.
FAILURE TO SUBMIT THE AGREEMENT AND SECURITY OR THE REQUEST
FOR AN EXTENSION OF TIME WILL RESULT IN THE EXPIRATION OF THE
ZONING GRANTED BY THE COUNCIL.
Pursuant to Fresno Municipal Code Section 12-404-K, the M-1/UGM
zoning will become effective upon the occurrence of one of the
following within the period as set forth in Section 12-1005.1(a)
of the Fresno Municipal Code, which is currently twenty-four (24)
months.

extension of the conditional approval of the zone district
amendment, and such extensions may be approved or approved
with conditions for the time and in the manner provided by
Section 12-1005.1 of the Fresno Municipal Code, relating to
the extension of approved tentative maps (24 months plus an
additional 24 months). A $690.00 processing fee (or current
fee at the time of request) must be paid to validate a
request for time extension at least 30 days before the
conditional approval expires.
EXPIRATION OF ZONING: The approved zoning shall expire if it is
not perfected pursuant to Section 12-404-K by December 7, 1995
(two years from date of Council action), excluding any approved
extensions.

THE CITY OF FRESNO HERETOFORE ADOPTED BY ARTICLES
1 TO 4.5 INCLUSIVE, CHAPTER 12, OF THE FRESNO
MUNICIPAL CODE, BEING THE ZONING ORDINANCE OF
THE CITY OF FRESNO.
WHEREAS, pursuant to the provisions of Article 4, Chapter 12,
of the Fresno Municipal Code, the Director of the Development
Department of the City of Fresno found the proposed rezoning in
conformance with adopted plans and policies of the City and
recommended to the Council of the City of Fresno an amendment to the
Zoning Ordinance which changes the real property described
hereinbelow from one zone to another; and
WHEREAS, this project was duly noticed with no formal appeals
being filed, thus, no hearing before the Planning Commission is
required; and
WHEREAS, the purpose of tale Local Planning and Procedures
Ordinance, that zoning be consistent with the land use designated on
applicable plans, will be frustrated if zoning on property is
allowed to revert to inconsistency with the land uses designated on
applicable plans because of failure to comply with certain
provisions of Section 12-404-K of the Fresno Municipal Code, and it
is therefore in the best interests of the City that compliance with
those provisions of Section 12-404-K be waived as a condition of
this rezoning.

SECTION I. Based upon the testimony and information presented
at the hearing and upon review and consideration of the
environmental documentation provided, the adoption of the proposed
rezoning is in the best interests of the City of Fresno. The
Council finds that with the implementation of the mitigation
measures defined within the Initial Study for Environmental
Assessment No. R-93-35, there is no substantial evidence in the
record that the rezoning may have a significant effect on the
environment, and the Mitigated Negative Declaration prepared for
this project is hereby approved. The above mitigation measures
shall be incorporated into the project, implemented and monitored as
specified in the monitoring program contained within the Initial
Study for Environmental Assessment No. R-93-35. The Initial Study
for Environmental Assessment No. R-93-35 is incorporated into this
ordinance and compliance therewith is made a condition of this
rezoning.
SECTION 2. The zone district of the real property described
hereinbelow, located in the City of Fresno, and shown on the
Official Zone Map of the City of Fresno, is reclassified from the
AE-5/UGM Zone District to the M-1/UGM Zone District:

SECTION 3. This ordinance shall be conditioned upon the record
owner of the real property subject to this reclassification
dedicating and providing, or agreeing to provide, improvements to
streets adjacent to the subject property as follows:
1. DEDICATIONS
a. Fowler Ave: Within the limits of the subject
property, dedication of a twenty one to twenty
five-foot easement for street right of way
along the entire frontage.
b. Offers of dedication for public easements
required by this section shall be submitted to
the City in a technically correct form within
sixty (60) days following council adoption of
this ordinance pursuant to Fresno Municipal
Code Section 12-404-J.l(b). The applicant must
provide the City with the legal description on
a standard deed form together with City
standard drawings for any required
dedications. Forms for said documents are
available from the Projects Engineering Section
in the Development Department.
The dedication documents shall be prepared at
no expense to the City. Additionally, a deed
check and recordation processing fee for each
document will be due at the time of submittal.
2. IMPROVEMENTS
a. Fowler Ave: Within the limits of the subject
property, installation of concrete curb, gutter
and twenty feet of asphalt concrete pavement
along the entire frontage plus transition
pavement as required by the Fresno City
Engineer.
b. Any existing utilities including, but not
limited to street lights, signal lights, and
fire hydrants requiring removal and/or
relocation to construct the above mentioned

improvements shall be done at no expense to the
City. All work shall conform to the adopted
Standard Specifications of the City of Fresno
Public Works Department.
c. All street improvement requirements shall
conform to City of Fresno Public Works
Department standards, policies and procedures.
SECTION 4. Compliance with Section 12-404-K of the Fresno
Municipal Code is expressly waived except that the expiration
provisions of Subsection 5 of said section related to the submittal
of required offers of dedication, a required agreement and security
for street improvements, or a required covenant agreement for other
conditions of zoning shall, remain in effect.
SECTION 5. This ordinance shall become effective and in full
force and effect at 12:01 a.m., on the thirty-first day after its
passage.

CRITERIA FOR MAP FORM AND CONTE4'T
1. A Lot Line Adjustment shall be legibly drawn to scale and in a manner to best illustrate the proposed division on a sheet
8-1/2 by 11 inches. A marginal line shall be drawn completely around the sheet leaving an entirely blank margin of one
half inch. The following information shall be shown on the map:
a. The boundary lines of the existing parcels, with dimensions, based on existing survey data or property descriptions.
b. The proposed adjusted line(s) with dimensions.
C. Identification of each existing parcel with a number designation corresponding to a like number on the legal
descriptions.
d. Identification of each adjusted parcel with a letter designation corresponding to a like letter on the legal descriptions.
e. All existing buildings and structures located on the existing parcels, together with their major exterior dimensions and
distance from the buildings and structures to the boundary line of the parcels which result from the proposed Lot
Line Adjustment.
f. The location of existing wells, septic tanks, leaching fields, and house branch sewer lines and water lines.
g. The location and names of all abutting streets, alleys and easements.

4. Perfection of an Approved Lot Line Adjustment Application
Perfection of this Lot Line Adjustment (LLA) must be completed prior to 4-01-2022
{1-year after the LLA approval date}. Should this LLA not be perfected within this time period, the
approval of this LLA will be deemed expired and any deeds recorded after this date may constitute a
violation of the State Subdivision Map Act.
To perfect the approved LLA:
a) The applicant must make arrangements for the recording of the perfecting deeds for all the
adjusted parcels of the approved LLA.
b) Upon completion of such recording, the applicant must submit to this office copies of the recorded
deeds reflecting the adjusted parcels.
