A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA,
APPROVING THE SUBMITALL OF A GRANT APPLICATION TO THE CALIFORNIA
DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY(CalRecycle)
BEVERAGE CONTAINER RECYCLING GRANT PROGRAM
WHEREAS, Public Resources Code sections 40000 et seq. authorize the Department of Resources
Recycling and Recovery (CalRecycle), to administer various Grant Programs (grants) in
furtherance of the state of California's (State) efforts to reduce, recycle and reuse solid waste
generated in the State thereby preserving landfill capacity and protecting public health and safety
and the environment; and
WHEREAS, in furtherance of this authority CalRecycle is required to establish procedures
governing the application, awarding, and management of the grants; and
WHEREAS, said procedures established by the State Department of Resources Recycling and
Recovery require the applicant to certify by resolution the approval of application before
submission of said application to the State; and
WHEREAS, CalRecycle grant application procedures require, among other things, an Applicant's
governing body to declare by Resolution certain authorizations related to the administration of
CalRecycle grants.
WYTHEREEORE,BEITRES_OL (-the-GounciLofAhe-Cit�y_-ofFresno-as_follows:
1. Authorizes the submittal of an application to CalRecycle for the Beverage Container
Recycling Grant Program; and
2. Delegates the authority to the City of Fresno, Director of Parks, After School, Recreation
and Community Services (PARCS) Department, or designated representative,to conduct
all negotiations, execute and submit all documents, including, but not limited to
applications, agreements, amendments, requests for payment, which may be necessary to
secure grant funds and implement the approved grant project subject to review of City
Attorney's Office; and
3. Agrees to comply with all applicable federal, state and local laws, ordinances, rules,
regulations and guidelines.
4. These authorizations are effective for five (5) years from the adoption of this resolution.
