RESOLUTION NO. 98-50
A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO,
CALIFORNIA, AMENDING THE FRESNO GENERAL PLAN (PLAN
AMENDMENT NO. A-97-018)
WHEREAS, on November 20, 1984, by Resolution No. 84-470, the Council adopted the 1984
Fresno General Plan; and
WHEREAS, on February 2, 1993,by Resolution No.93-43,the Council adopted an amendment
to the 1984 Fresno General Plan to require 56-foot wide street right-of-way for residential
developments of more than four units per acre; and
WHEREAS,the Development Department received an application from McCaffrey Development
to amend the aforementioned general plan to allow the use 50-foot wide street right-of-way for the
subject site of 23.59 acres located on the north side of West Spruce Avenue between North Gregory
Avenue and West Herndon Avenue; and
WHEREAS,the environmental assessment conducted for the proposed plan amendment resulted
in the filing of a negative declaration; and
WHEREAS, on January 21, 1998, the Planning Commission held a public hearing to consider
Plan Amendment No. A-97-018, and after consideration of environmental documents, testimony and
information presented, determined that the adoption of the proposed amendment is in the best interest
of the City of Fresno; and
WHEREAS, on February 3, 1998, the Council held a public hearing to consider Plan
Amendment No. A-97-018 and determined based upon the testimony and information presented at
the hearing and upon review and consideration of the environmental documentation provided that the

adoption of the proposed amendment is in the best interest of the City of Fresno.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno as follows:
1. The Council finds that, in accordance with their own independent judgement, there is no
substantial evidence in the record that Plan Amendment No. A-97-018 may have a
significant effect on the environment and hereby adopts the negative declaration prepared
for this project.
2. The Council of the City of Fresno hereby approves Plan Amendment No.A-97-18 amending
the 1984 Fresno General Plan to allow the use of fifty-foot wide local residential streets with
sidewalks on both sides of the streets for only the Subject Site.

SPECIFICATIONS
1. 36 feet from curb face to curb face.
2. Two-way traffic.
3. Parking allowed on both sides.
4. Sidewalk shall be installed on both sides, one side, or deleted..
5. Monolithic sidewalk and driveway standard is applicable.
6. Greater right-of-way may be approved. In such cases, t-foot
sidewalk shall be installed 6 inches from property line
(exception may be approved for a meandering sidewalk).
7. 1,500-foot maximum length of .continuous street.
8. In other than single-family areas, this street section can only •
be used on cul-de-sacs and on one-block streets not exceeding
800 feet in length.
9. A 27 foot minimum setback is required from curb line to garage
when the garage door fronts on street. The setback can be
reduced by four feet if a roll-up garage door is installed and
there is not sidewalk. The setback shall not be less than
required oy the Zoning Ordinance.
10. This standard is suoject to the pipeline installation
requirements formula.
11. F.I.D. facilities shall be located in a separate easement out
of the street area.

12. Street furniture shall be located in accordance with street
furniture location diagram.
13. This standard can be used in conventional development, planned
unit developments, or other residential developments. •
14. 34 feet from curb face to curb face is acceptable in this
right-of-way if used on a loop street or a loop street with
cul-de-sacs it the maximum number of residential units served
by the loop street does not exceed 75 and no through traffic
will be carried by the street.
15. On corner lots, the planting and utility easement along the
side yard may be reducedto eight feet.
16. API geometric cross section;shall not be combined with
standard geometric cross sections.
