RESOLUTION ORDERING CHANGES IN WORK
ASSESSMENT DIS'!'RICT NO. 55
. HESOLVED, by tho Council of the City 0 f Fresno I
California, that
WJIEREAS, said Council did on the 22nd day of
February, 1973, adopt i~s Resolution of Intention wherein it
did declare that in its opinion the public interest and
convenience required that work be done and improvements be
made as described and specified in said Resolution of
Intention, and
WHEREAS, said Council did thereafter adopt its
resolution calling for sealed proposals for said work and
improvements, and
WHEREAS, said Councii did on the 24th day of May,
1973, adopt its Resolution No. 73-279 awarding the contract
for Phase I, the construction of storm drainage facilities,
to Larry V. Thomason Co., Fresno, California, and
.WHEREAS, the Engineer of Work did thereafter
recommend that a change order be authorized to provide for
the install~tion of 744 lineal £eet o£ 12 inch reinforced
concrete pipe in Clay Avenue between Bond and Fisher Avenues,
the installation of one additional inlet structure, and the
installation of one additional manhole at said location, at
a total cost of $8,490.00 to be paid by the City to said
contractor for such additional work and materials, and
WHEREAS, the Engineer of Work did further recommend
that said additional cost be: defrayed by an increase of

$8,490.00 in the contribution of Fresno Metropolitan Flood
control District, said contribution to be advanced by the
City of Fresno in accordance with its c6ntract heretofore
made with Fresno Metropolitan Flood Control District, and
. WHEREAS , the Council did on the 25th day of October,
1973 adopt its resolution describing said proposed changes
and did appoint the 8th day of November, 1973 at 8:00 o'clock
p.m. of said day in .the meeting room of said council, council
Chambers, City HalL Fresno, California, as the time and plac/3
for hearing any objections to the proposed changes, and
WHEREAS, the Council did on November I, 1973 adopt
its "Resolution Resetting Time of Hearing on proposed
Changes and Directing Notice ll
, whereby said hearing time "laS-'
changed and reset for Thursday, November 15, 1973 at 8:15
o'clock p.m., and
WHEREAS, notice of the time and place for said
hearing was given in th(~ time and manner required by 1 a", and
affidavits of compliance with the requirements of notice are
on file with the City Clerk, and
WHEREAS, said hearing was duly held by the Councii
at the time and place set forth therefor, and
WHEREAS, there were no 'Ilr it ten obj ections to said
proposed changes delivered to the Clerk up to the hour set
for hearing and there were no verbal objections.
NOW, THEREFORE, IT IS ORDERED, AS FOLLOWS:
1. The Council finds that there were no written
objections nor any verbal objections to the proposed changes
as described in that certain resolution adopted on October
25th, 1973, in the matter of City of Fresno Assessment District

No. 55 entitled "Resolution Describing Proposed Changes in Work
and Appointing Time and Place of Hearing".
2. The Council of the City of Fresno does hereby
authorize a change in the work and improvements of Phase I,
the construction of storm drainage facilities, City of Fresno
Assessment District No. 5S to provide for the installation
of 744 lineal feet of 12 inch reinforced concrete pipe f the
installation of one additional inlet, the installation of one
additional manhole, all in Clay Avenue between Bond and Fisher
Avenues, at a total cost of $8,490.00 said work to be done
by the contractor to whom the bid for said Phase I has
heretofore been awarded.
3. The Council of the City of Fresno does hereby
increase the reimbursable contribution to be advanced by it
pursuant to its contract with Fresno Metropolitan Flood
Control District, said increase to be in the amount of $8~490.00J
to defray the cost of said change. No supplemental assessment
shall be levied by reason of said change in these proceedings.
4. The Engineer of Work is hereby ordered and
directed to note the hereinabove specified changes on the
plans and specifications on file in these proceedings and to
make a change order in accordance herewith for the doing of
said additional work by the contractor for said Phase I.
