A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, AMENDING THE ROOSEVELT COMMUNITY PLAN (PLAN AMENDMENT APPLICATION NO. A-00-01) WHEREAS, on April 7, 1992,by Resolution No. 92-141,the City Council adopted the Roosevelt Community Plan; and, WHEREAS, David K. Ruschhaupt has filed an application to amend the land use designation of the aforementioned plan from medium density residential and open space/ ponding basin to light industrial for an 1.09±acre parcel located at 2503 South Chestnut Avenue (eastside of Chestnut both north and south of the East Byrd Avenue alignment); and, WHEREAS,the environmental assessment conducted for the proposed plan amendment resulted in the filing of a negative declaration; and, WHEREAS, on May 3, 2000,the Fresno City Planning Commission held a public hearing to consider Plan Amendment No. A-00-01, and the negative declaration for Environmental Assessment No. A-00-01,R-00-03 and S-00-48, dated April 7, 2000; and, WHEREAS,the Fresno City Planning Commission took action to recommend approval of the negative declaration for Environmental Assessment No.A-00-01, R-00-03, and S-00-48; and, WHEREAS,the Fresno City Planning Commission also took action to recommend approval of Plan Amendment No. A-00-01,which would amend the plan designation for the subject site from medium density residential and open space/ponding basin to light industrial; and, WHEREAS, on May 23, 2000,the Fresno City Council held a public hearing to consider Plan Amendment Application No. A-00-01 and determined,based upon information presented at the hearing and upon review and consideration of the environmental documentation provided that the adoption of the proposed amendment is in the best interest of the City of Fresno. That Council finds based upon its own independent judgment,that there is no substantial evidence in the record that Plan Amendment Application No. A-00-01 may have a significant effect on the environment and hereby adopts the negative declaration dated April 7, 2000. 2. The Council of the City of Fresno hereby adopts Plan Amendment Application No. A-00-01, amending the land use designation of the Roosevelt Community Plan from the medium density residential and open space/ponding basin to light industrial plan designation as depicted on Exhibit A, attached hereto and incorporated herein by reference.
