HomeMy WebLinkAboutResolution - - 2006-062 - 2/14/2006tlPp,oad RESOLUTION NO. 2006-62 A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, AUTHORIZING CERTAIN FINANCE OFFICERS OF THE CITY OF FRESNO TO SIGN CITY CHECKS AND VARIOUS INVESTMENT AND COMMERCIAL BANKING DOCUMENTS, AND TO PROVIDE VERBAL INSTRUCTION AS REQUIRED FOR THE PRUDENT FINANCIAL ADMINISTRATION AND SAFEKEEPING OF CITY FUNDS WHEREAS, the City of Fresno (the "City") is a chartered city duly organized and existing under and pursuant to the provisions of the Constitution of the State of California and the Charter of the City; and, WHEREAS, Charter Section 804 establishes the position of Controller to be appointed by the Chief Administrative Officer with the approval of the Council, to have the authority and responsibility for the administration of the financial affairs of the City; and, WHEREAS, the effective and efficient execution of the financial affairs of the City requires that certain Finance Officers be appointed and authorized to sign City checks, sign various investment and commercial banking documents, approve electronic transfers of funds, and provide verbal instructions in connection with the prudent administration and safekeeping of City funds; and, WHEREAS, it is the intention of the Interim Controller to delegate the authority granted by Charter Section 804 to perform the aforementioned financial transactions and to provide for Council's approval a list of responsible Finance Department employees, along with their exemplar signatures, to be designated as Finance Officers, NOW THEREFORE, IT IS RESOLVED by the Council of the City of Fresno, California, as follows! 1. The Interim Controller for the City of Fresno, and the Finance Department employees, all of whose names and signatures are shown below, are designated as Finance Officers of the City of Fresno. 2. The Interim Controller is authorized to sign City checks with either her,handwritten or facsimile signature acting alone. Any two of the other four Finance Officers designated herein, acting together, are authorized to sign City checks by facsimile or handwritten signature. 3. KLISCH City Clerk RESOLUTION NO. 2006-63 A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, RESCINDING RESOLUTION NO. 88-30, WHICH ORDERED THE VACATION OF PORTIONS OF CALWA AND LILY AVENUES, AND RESOLUTION NO. 97-03, WHICH ORDERED THE VACATION OF A PORTION OF THE CEDAR AVENUE FRONTAGE ROAD SOUTH OF BELLAIRE WAY WHEREAS, various entitlement projects have been proposed that required the vacation of certain street right-of-ways; and WHEREAS, Public Works recently reviewed fourteen resolutions ordering the vacation of certain street right-of-ways that were adopted by Council but are still pending because none of the conditions for approval of the vacations were satisfied and the Resolutions were never recorded with the Fresno County Recorder's Office; and WHEREAS, Public Works notified the Applicants of these still pending vacations by mail and requested that they indicate whether they still intend to pursue the vacations to their completion; and WHEREAS, Public Works found that two of the projects that required vacations have been dropped by the Applicants and are not going to be pursued; and WHEREAS, the Public Works Department is therefore requesting that Council adopt the attached Resolution rescinding Resolution No. 88-30, which ordered the vacation of portions of Calwa and Lily Avenues, and Resolution No. 97-03, which ordered the vacation of a portion of the Cedar Avenue Frontage Road South of Bellaire Way; and WHEREAS, the areas subject to the unrecorded/abandoned vacations are shown on Attachment "A" and Attachment "B"; and WHEREAS, this resolution seeks to rescind earlier Resolutions Nos. 88-30 and 9.7-3 puthorizing the unrecorded vacations. Code Sections 6103 and 27383 When Recorded, Mail To: City Clerk City of Fresno 2600 Fresno Street Fresno, CA. 93721-3623 SPACE ABOVE THIS LINE FOR RECORDER'S USE RESOLUTION NO. 97-3 A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA ORDERING THE SUMMARY VACATION OF A PORTION OF THE CEDAR AVENUE FRONTAGE ROAD SOUTH OF BELLAIRE WAY WHEREAS, the Council has elected to proceed under the provisions of the Public Streets, Highways, and Service Easements Vacation Law (Division 9, Part 3 of the California Streets and Highways Code), and specifically Chapter 4 (commencing with Section 8330) thereof, to summarily vacate a portion of the Cedar Avenue Frontage Road south of Bellaire Way; and WHEREAS, the public street easement proposed to be vacated is shown on Exhibit "A", which is attached to and incorporated in this Resolution; and WHEREAS, no public facilities located within the public street easement proposed to be vacated will be affected by the proposed vacation because a public utility easement shall be reserved over the entire area to be vacated; and WHEREAS, the Council finds from all the evidence submitted that the public street easement to be vacated is excess right-of-way not needed for present or prospective public street purposes; and WHEREAS, Environmental Assessment No. 96-103 shows with certainty that there is no possibility that the proposed summary vacation may have a significant adverse effect on the ..■ ,a� ■ No E ■ .. q � - .3 environment, and the proposed summary vacation is therefor exempt from the California Environmental Quality Act (CEQA) pursuant to Subsection 15301(c) of the CEQA guidelines; and WHEREAS, the Council desires to summarily vacate such public street easement. NOW, THEREFORE, IT IS RESOLVED BY THE COUNCIL OF THE CITY AS FOLLOWS: 1. A portion of the Cedar Avenue Frontage Road south of Bellaire Way, as shown on Exhibit "A", is hereby vacated. 2. The City reserves the entire area to be vacated as a permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers, water mains, storm drains, and appurtenant structures in, upon, and over the public street easement proposed to be vacated and, pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment, and fixtures for the operation of gas pipelines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia and water, and for incidental purposes, including access to protect such works from all hazards in, upon, and over the public street easement to be vacated. 3. The City Clerk ("Clerk") shall certify to the passage of this Resolution and shall file a certified copy, attested by the City Clerk under the seal of the City, in the Office of the City Clerk. 4. The Clerk shall certify to the passage of this Resolution and shall cause a certified copy, attested by the Clerk under the seal of the City of Fresno, to be recorded in the Office of the County Recorder of the County of Fresno, State of California. 5. This vacation shall become effective on the date this resolution is recorded. r. 6. File No. 8555 RESOLUTION NO. 88-30 A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, ORDERING THE VACATION OF CALWA AVENUE BETWEEN ELM AND LILY AVENUES AND LILY AVENUE NORTH OF DOROTHY STREET WHEREAS, pursuant to Resolution of Intention No. 896-D, on file in the Office of the City Clerk, a public hearing was held on the 26th day of January, 1988, at a regular meeting of Council of the City of Fresno, California, at which time and place evidence was heard for and against the vacation of the hereinafter described right-of-way or part thereof, situated within the City of Fresno; and WHEREAS, the City Traffic Engineer has reviewed the proposed vacation action and determined that it will have no adverse effect upon traffic circulation; and WHEREAS, Environmental Assessment No. P. W. 87-078 shows with certainty that there is no possibility that the proposed vacation action may have a significant effect on the environment and the proposed vacation is therefore not subject to the California Environmental Quality Act (California Public Resources Code Section 21000 et. seq.); and WHEREAS, this action is being taken pursuant to the provisions of the Public Streets, Highways, and Service Easements Vacation Law (Streets and Highways Code of the State of California Sections 8300-8363). NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FRESNO AS FOLLOWS: 1. The Council finds from all the evidence submitted that the right-of-way or part thereof to be vacated as shown on Exhibit "A" is unnecessary for present and prospective public street purposes. Exhibit "A" is attached and incorporated into this Resolution. The Council further finds that such right of way or portion thereof is`. not useful as a bicycle path or route. 2. The public interest and convenience require, and it is hereby ordered, that as contemplated by Resolution of Intention No. 896-D adopted by the Council of the City of Fresno on the 5th day of January, 1988 the right of way or part thereof shown on Exhibit "A" be and is hereby closed, vacated and abandoned for public street purposes subject to the conditions indicated on Exhibit "B" attached hereto and incorporated into this Resolution. 3. That the City of Fresno reserves and excepts from the proposed vacation that portion as indicated on said Exhibit "A" as a permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers, water mains, storm drains, and appurtenant structures in, upon, and over the rights-of-way proposed to be reserved and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew, and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment, and fixtures for the operation of gas pipelines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, water, and incidental purposes, including access to protect such works from all hazards in, upon, and over the rights-of-way to be reserved. 4. The City Clerk of the City of Fresno shall certify to the passage of this Resolution and shall file a certified copy, attested -2- by the Clerk under the seal of the City of Fresno, in the Office of the City Clerk. 5. The City Clerk shall file a certified copy of this Resolution for recordation in the Office of the Recorder of Fresno County, but not until the Director of Public Works determines in writing that the conditions specified in Exhibit "B" have been satisfied and accepted by the City.
