A RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO, STATE OP CALIFORNIA, WITHDRAWING
CERTAIN AREAS FROM THE MID-VALLEY FIRE
PROTECTION DISTRICT (CHURCH-WALNUT NO.1)
WHEREA~, the City of Fresno is a municipal corporation duly
organized and existing under the Constitution and laws of the
State of California, and the Council of the City of Fresno is the
legislative body of such city under its Charter; and
WHEREAS, by Resolution No. 73-16 of the City of Fresno, which
resolution became effective January II, 1973, the real property
hereinafter described then situated outside th~ Fresno city limits,
in the County of Fresno, state of California, was annexed to the
City of FresnOj and
WHEREAS, the resolution has been filed with the Secretary of
State, and an affidavit of completion was filed with the County
Recorder on February 22, 1973j and
WHEREAS, the hereinafter described area at the effective date
of such annexation was and now is located within the exterior
boundaries of the Mid-Valley Fire Protection District; and
WHEREAS, Section 13952 of the Health and Safety Code of
California provides, in substance, that \lJhenever any portion of a
fire protection district is included \vi thin a city by reason of
annexation, such portion may be withdrawn.f:romthe fire protection
district, such withdrawal to be effective on the date fixed by the
legislative body of the city, which date shall not be more than two
years after said an,nexation proceedings are completedj and
WHEREAS, this resolution supersedes Resolution No. 73-86
adopted February IS, 1973 and the same is hereby repealed.
NOW I TH.EREFORE, THE COUNCIL OF THE CITY OF F.RESNO DOES HEREBY
RESOLVE AND DECLARE that the follO\oJing described area be, and the
same is, withdrawn from the Mid-Valley Fire Protection District,
effective as of date of adoption.
