A RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO, STATE OF CALJPOHNIA, HI'PIIDRAWING
CERTAIN AREAS FROM 'lIBE MID-VALLEY FIRE
PROTECTION DISTRICT (HERNDON-CHESTNUT No. 3A)
WHEREAS, the City of Fresno is a municipal corporation duly
organized and existing under the Constitution and laws of the
State of California, and the Council of the' City of Fresno is the
legislative body of such city under its Charterj and
\oJHEREAS, by Resolution No. 73-27 of the City of Fresno, which
resolution became effective January II, 1973, the real property
hereinafter described then situated outside the Fresno city limits,
in the County of Fresno, State of California, 'vas annexed to the
City of Fresno; and
WHEREAS, the resolution has been filed with the Secretary
of State, and an affidavi t of completion \.,as filed wi th the County
Recorder on February 5, 1973; and
WHEREAS, the hereinafter described area at the effective date
of such annexation was and now is located vlithinthe exterior
boundaries of the Mid-Valley Fire Protection District; and
WHEREAS, Section 13952 of the Health and Safety Code of
California provides, in substance, that whenever any portion of
a fire protection district is included within a city by reason
of annexation, such portion may be withdrawn from the fire protection
district, such withdrawal to be effective on the date fixed by the
legislative body of the city., \vhich date shall not be more than two
years after said annexation proceedings are completed; and
WHEREAS, this resolution supersedes Res'olution No. 73-87
adopted February IS, 1973 and the same is hereby repealed .
. NOW, THEREFORE, THE COUNCIL OF THE CITY OF FRESNO DOES HEREBY
RESOLVE AND DECLARE that the following described area be, and the
same is, withdrawn from the Mid-Valley Fire Protection District,
effecti ve as of date of adoption.
