. A RESOLUTION OF THE COUNCIL OF 'l'lm CI IJ!Y OF
l?fiESNO :ACCEPTING Il<lPROVENENTS TO PARKING AREA
PURSUAWl' '1'0 PARKING 1\GRBENEN'l' \UTH LONGS DRUG
STORES, INC.
RESOLVED, by the council of the City of Fresno/California,
NHEREAS, the City heretofore entered into a Parking :Agreement,

dated November 1J 1971, with Longs Drug stores, Inc. (IILongsff), wherein
the parties agreed that, among other things, Longf) would .improve, at
Longs l expense and in accordance with designated plans and specifications,
a certain described area (called therein the "Parking Area") for use as
a public parking lot to be conveyed to and operated by the City after
completion of the .improvements and their acceptance by the City; and
\-1HEREAS, as reported to this council by the public Works Director,
said improvements have been completed by Longs in substantial conformity
with the designated plans and speci.fications except for substitution of
planter. pots for an omitted section of planters parelleling Fulton .Mall
and the omission of drive\>Tay appr.oaches for a proposed future Mall crossing I
which omitted improvements have been determined to be impractical to
install because their installation vlould likely cause serious damage to
the Mall under existing subsurface conditionsj and
WHEREAS, no consideration having been paid by City for these improve-
ments, the above-recited deviations from compliance with the specifications
may be approved by the' Council and strict compliance in such respects
. waived;
NOW] THEREFORE, the Council hereby 'tlniVCB compliance with said plans
and specifications as to the hereinbefore-described substitution and·
omissions, and accepts said improv~aents to said Parking Area as other-
\iisecompleted in conformance with said plans and specifications.
