A RESOLUTION DETERMINING PUBLIC CONVENIENCE
AND NECESSITY OF PROPOSED IMPHOVEMENT
ASSESSMENT DIS'llRr CT NO. 56
RESOLVED, by the Council of the city of Fresno,
California, that
WHEREAS, on December 7, 1972, this Council adopted its
Resolution No. 72-336 pursuant to the requirements of Article
17, Chapter 15 of the Fresno Municipal Code, preliminarily
determining and finding that public convenience and necessity
require that the area, the precise boundaries of which are as
shown on the map, designnted thereon as Assessment District
No. 56 on file with the City cJ.er.k, requires the works and im-
provements hereinafter described, and that appropriate special
'. assessment and assessment bond proceedings should be taken with;..
out complying with the provisions of the Special Assessment
Investigation, Limitation and Majority protest Act of 1931; and
WHEREAS, said Resolution did further· fix Thursday, January 4,
1973, at the hour of 9:45 o'clock a.m. of said day in the council
Chamber, City Ball, Fresn(), California, as the time and place
for the hearing of all persons intereBtocl P-D tho guestion of
'whether the council should finally find and determine that the
public convenience and necessity r.equire the proposed work and
improvements, and that special assessment proceedings should be
taken therefor without compliance with the Special Assessment
Investigation, Limitation and Majority Protest Act of 1931; and
WHEREAS , it appears that said Resolution 'lIas duly posted
and published in the time, form, and manner required by said
Code; as evidenced by the affidavits on file witht:he city

WHEREAS, said hearing was duly and regularly held at
the time and place fixed in said Resolutionj and
WHEREAS, at said hearing all persons interested and
desiring to be heard were given an opportunity to be heard and
to object to undertaking said proceedings vii thout first com-
plying with the provisions of said Act, and all matters and
things pertaining to the public convenience and necessity of
the improvements and the undertaking thereof by special assess-
ment bond proceedings were fully heard and considered by the
Council;
NOW I THEREFORE, IT IS HEREBY FOUND, DE'rERMINED I AND ORDERED
AS FOLLOWS:
1. The following is a general description of the works
and improvements within the proposed assessment. dist.rict, the
boundaries of which are more particularly shown on the map on
file with the Clerk of the city of Fresno, designated as Assess-
ment District No. 56:
(a) The construction of curbs l gutters, sidewalks
and driveway approaches where required.
(b) Transition work and construction of all improve-
ments auxiliary to any of the foregoing and necessa.ry to
complete same in accordance with the requirements and
_ iroprovemen t s-tandards of the Ci ty of Fresno.
2. The public convenience and necessity require that the
proposed improvemonts be dona and rtlaoo I and that the Special
Assessment Investigation, Limitation and Majority Protest .Act
of 19.31 shall not apply.
This resolution shall take effect and be in force upon
its adoption. ~_O
