RESOLUTION NO. 71-323
RESOLUTION OF INTENT TO VACATE TEMPORARY
ALLEY UPON PERFORMANCE OF CONDITION
-WHEREAS, pursuant to Resolution of Intention No. 644-D adopted
on September 16, 1971~ this council declared its intention to order
the vacation of atemporary-a.lley described as:
The North 20.00 feet of the North 60.00 feet of the West 120 • 00
feet of. Lot 81 of Tract No. 1555 Bel-Air No.5, Fresno County
Califor.nia; according to the map thereof recorded January 31,
1956, in Book 18, Page 35 of Plats, Fresno County ~ecords.
-_ wi thin the city of Fresno, and fixed the hour of 9: 15 0' clock a.m. i
of the 7th day of ·october, 1971, in the Council Chamber of the Fresno
city Hall, 2326 Fresno Street, Fresno, California, as the time and place
-for hearing thereon, and
\lmEREAS, the Council at said hearing has received and considered
the evidence submitted and finds as follows:
1. Due notice of said hearing was given as required by law.
2. Said temporary alley is unneCessary for present or prospective
alley pu~po~es,provided the following work is done prior to
-the vacation thereof;
construct alley improvements on the deeded right of way for-
the extension of the existing Hughes-Hulbert alley south to
Shields Avenue, said alley improvements to be constructed as
per.Fresno.City Standard specifications 1970 as amended and
standard Drawing No~ P-lO.
1'1'. IS RESOLVED that, the hearing having been closed, the matter
shall be and it is hereby continued to the 6th day of January, 1972,
at which time or at such later time to which said matter may be£urt.her
.. continued -, it is the intention of this Council to adopt an appropriate
resolution pursuant tq Sections 8300-8331 of the Streets and Highways
Code, ordering the vacation of this temporary alley as described-in
Resolution of-Intention No. 644-D provided evidence is submitted to
the satisfaction of the Council that the hereinbefore--described work has··
been completed without cost to the City;
AND. RESOLVED FURTHER that the public Works Director is authorized
to execute,' on behalf of the city, such agreement or
Qwner.or·oWners of property on which the street area to be vacated is
located as s~id Director deems necessary to insure the completion of .
