RESOLUTION CONFIRMING REPORT OF DIRECTOR OF
PUBLIC WORKS AND ASSESSING THE COST OF CONSTRUCTION
OF CONCRETE CURBS, GUTTERS AND SIDEWALKS ON VARIOUS
STREETS IN THE CITY OF FRESNO

WHEREAS, on September 17, 1970, the Council received the report
of the Director of Public l'lorks, theretofore filed with the City Clerk,
of the work done and cost thereof in the construction of curbs, gutters
and sidewalks where ordered by Resolution Nos. 69-150 and 69-199, -in
front of the parcels of real property situated on various streets and
described in said report, together with the amount of the assessment 0
proposed to be made against said parcel of property, and
WHEREAS, the Council finds that the Director of Public Works has
heretofore causednotlce to be duly given, in the manner provided by
law, to the owner or person in posRession of each of said parCe1s,oof
the cost-of said construction and the assessment against each of said
parcels proposed to be levied-to pay said cost, and of the time and
pla~e set for hearing thereon, which time and place ~as stated in s~id
notice as september 17, 1970, at the hour of 9:15 a.m. in the Council
Chamber, City Hall, 2326 Fresno Street, Fresno, California and
-WHEREAS, at said time and place the Council has considered and
passed upon said report of the Director of Public Works of the cost
of said construction, including evidence oral and documentary received
_ concerning the proper completion of the work, and the cost thereof,
and has heard and considered any and all objections and protests of
property owners and other interested persons; and
WHEREAS, by Resolution No. 7o M 163 this Council authorized payment
of the assessments mentioned therein to be made in ten equal annual
installments}
NOW, THEREFORE, BElT RESOLVED that said report of the Director
of public Works is hereby confinned, and the cost of construction as
set forth therein, of the work described therein is hereby assessed
against each parcel of property fronting upon the work so constructed,
-and particularly-described in said report, in the sum set forth in said_
-report as the assessment: against such parcel.
BE IT FURTHER RESOLVED that if any assessment herein assessed.
_ shall not be paid within five (S) days after the date of adoption of
-this resolution, the Director of Public Works shall execute and file
in the Office of the County Recorder of Fresno County a notice of lien
against each parcel of property for which the assessment has nqt been
paid within said time and, after said notice of lien has beeri so 'filed
of record, with the exception of those assessments specifically provided
for in Resolution No. 70-163. ' ,wherein said assessments may be made ~
in ten equal annual installments, to deliver the sarne to the Auditor--
Controller of Fresno County for entry of the amount thereof on the
-county assessment book opposite the description of said parcel of
property, said amount to be collected together with all other taxes
thereon against-the property in the manner provided by law.
