RESOLUTION NO. 2001-417
A RESOLUTION OF THE COUNCIL OF THE CITY OF
FRESNO, CALIFORNIA; APPROVING CONDITIONAL
USE PERMIT NO. C-01-179
WHEREAS,THE Development Department has received Conditional Use Permit
Application No. C-01-179 from George Donovan requesting authorization to construct 85,143
square feet of retail space,which includes alcohol sales and two drive-up facilities, and 70,000
square feet of office space; and
WHEREAS,the environmental assessment prepared for the project resulted in the filing of a
Mitigated Negative Declaration; and
WHEREAS, on December 5, 2001,the Fresno City Planning Commission held a public
hearing to consider Conditional Use Permit No. C-01-179,related entitlements and the Mitigated
Negative Declaration prepared for Conditional Use Permit No. C-01-179,dated November 1, 2001,
and during said hearing took action to recommend the approval of the requested conditional use
permit and mitigated negative declaration.
NOW THEREFORE,BE IT RESOLVED by the Council of the City of Fresno as follows:
1. That Council finds that in accordance with their own independent judgement,there is
no substantial evidence in the record that Conditional Use Permit No. C-01-179,may
have a significant effect on the environment and hereby adopts the Mitigated Negative
Declaration prepared for the project.
2. That Council, after receiving the staff report and testimony,have determined that the
findings necessary to grant this conditional use permit, in accordance with Section
12-321-C-5 of the Fresno Municipal Code,have been met, and hereby approves
Conditional Use Permit No. C-01-179, subject to the following conditions;
a. Development shall be in accordance with Exhibit A dated August 23, 2001 of
Mutt Conditional Use Permit No. C-01-179.

b. Development shall be in accordance with the Special Permit Conditions of
Approval dated November 27,2001.
c. Development shall be in accordance with the General Conditions to Project
Approval.
