PURPOSE
The purpose of this policy is to clarify the requirement for Class C roof coverings on large-
family daycare, residential care facilities (RF) and residential care facilities for the elderly
(RCFE) within the City of Fresno and contract service areas.
APPLICATION
This policy applies to all large-family daycare facilities, residential care facilities and
residential care facilities for the elderly licensed by a government agency.

OPERATIONAL GUIDELINE
As noted in the California Fire Code (CFC), the fire code official has the authority to
formulate policies they deem necessary based upon local conditions related to
construction installations.
New large-family daycares are not required to replace existing roof coverings that do not
meet the Class C roof coverings rating.
New Residential Care Facilities (RF) are not required to replace existing roof coverings
that do not meet the Class C roof coverings rating.
New Residential Care Facilities for the Elderly (RCFE) are required to replace existing roof
coverings that do not meet the Class C roof coverings rating before the Fresno Fire
Department (FFD) will approve a fire clearance for that facility.

PROCESS
When FFD receives a request to grant a fire clearance (State 850 form) for a RCFE, the
FFD inspector will conduct an inspection at the location. During the inspection, if it is
discovered that the existing roof covering on the structure is not made of Class C compliant
roofing materials, the inspector will notify the applicant that the existing roof covering must
be replaced with a compliant Class C roofing material before a fire clearance will be
granted.
INFORMATION
As stated in CFC Appendix Chapter 4, Section 435.2.2, pursuant to Health and Safety
Code, Section 13133, regulations of the State Fire Marshal pertaining to occupancies
classified as Residential Facilities (RF) and Residential-care facilities for the Elderly
(RCFE) shall apply uniformly throughout the state and no city, county, city and county,
including a charter city or charter county or fire protection district shall adopt or enforce
any ordinance or locate rule or regulation relating to fire and panic safety which is
inconsistent with these regulations. A city, county, city and county, including a charter city
or charter county may, pursuant to Health and Safety Code, Section 13143.5, or a fire
protection district may, pursuant to Health and Safety Code, Section 13869.7, adopt
standards more stringent than those adopted by the State Fire Marshal that are reasonably
necessary to accommodate locate climate, geological or topographical conditions relating
to roof coverings for Residential-care Facilities for the Elderly.
As stated in CFC Appendix Chapter 4, Section 455.6 (paragraph 2), enforcement of the
provisions shall be in accordance with the Health and Safety Code Sections 13145 and
13146. No city, county, city and county, or district shall adopt or enforce any building
ordinance or local rule or regulation relating to the subject of fire and life safety in large-
family daycare homes which is inconsistent with those standards adopted by the State Fire
Marshal, except to the extent the building ordinance or local rule or regulation applies to
single-family residences in which day care is not provided.
DEFINITIONS
Day-Care Home, Large Family – A provider’s own home licensed to provide day care for
periods of less than twenty-four (24) hours per day for nine to fourteen (14) persons,
including children under the age of ten (10) years who reside at the home. CFC, Chapter

Residential Care Facility – Any family home, group care facility, or similar facility
determined by the director of Social Services, for twenty-four (24) hour nonmedical care
of persons in need of personal services, supervision, or assistance essential for sustaining
the activities of daily living or for the protection of the individual.

Residential Care Facility for the Elderly (RCFE) – A facility with a housing arrangement
chosen voluntarily by persons sixty (60) years of age or over, or their authorized
representative, where varying levels and personal care are provided, based on their
varying needs, as determined in order to be admitted and to remain in the facility. Persons
under sixty (60) years of age with compatible needs, as determined by the Department of
Social Services in regulations, may be allowed to be admitted or retain in a residential care
facility of the elderly.
