A RESOLUTION OF THE COUNCIL OF THE
CITY OF FRESNO CALIFORNIA, AMENDING
CITY OF FRESNO NONDISPOSAL FACILITY ELEMENT
WHEREAS, the State of California has enacted the California Integrated Waste
Management Act of 1989;
WHEREAS, each jurisdiction is required to prepare and adopt a Nondisposal
Facility Element pursuant to Public Resources Code (PRC), Division 30, Part 2,
Chapter 4.5, Sections 41730 et seq.;
WHEREAS, the City adopted the Nondisposal Facility Element on November 15,
1994, attached hereto as Exhibit A;
WHEREAS, the City amended the Nondisposal Facility Element on August 27,
2002,attached hereto as Exhibit B;
WHEREAS, the Nondisposal Facility Element is consistent with the Source
Reduction and Recycling Element, and the Household Hazardous Waste Element, of
the Countywide Integrated Waste Management Plan;
WHEREAS, Fresno City Public Utilities Department has requested that the
Sunset Waste Paper Recycling and Transfer Station be included within the City of
Fresno's Nondisposal Facility Element, attached hereto as Exhibit C;
WHEREAS, Title 14, Chapter 9, Article 7.0, Section 18766(b)2, California Code
of Regulations, requires each jurisdiction to conduct a public hearing for the purpose of
amending the Nondisposal Facility Element, and at the public hearing, each jurisdiction
shall amend the Nondisposal Facility Element by Resolution after considering all
comments of members of the governing body and the public;
WHEREAS, in order to permit additional Nondisposal Facilities within the
County, and amendment to the Nondisposal Facility Element is necessary;
WHEREAS, the Nondisposal Facility Element is exempt from the provisions of
the California Environmental Quality Act pursuant to Public Resources Code (PRC)
Division 30, Part 2, Chapter 4.5, Section 41735(a);
WHEREAS, in September 2002, the Sunset Waste Material Recovery and
�ppo�d
Transfer Station processed a conditional use permit to operate a waste material
recovery and transfer station, necessitating an amendment to the Nondisposal Facility
Element; and,
WHEREAS, On October 1, 2002 the Fresno City Council conducted another
public hearing to consider the proposed amendment to the Nondiposal Facility Element
attached hereto as Exhibit C.
NOW, THEREFORE, BE IT RESOLVED, that the City of Fresno hereby amends
the Nondisposal Facility Element as set forth in Exhibit C attached hereto.

Article 6.4 of the California Code of Regulations, Sections 18752 through 18754.5 were

Information required for each facility desc:zpaon is as follows:
1. For facilities within the jurisdiction that recover more than 5 percwtt of the total volume

A RESOLUTION OF THE COUNCIL OF THE CITY OF FRESNO, CALIFORNIA, ADOPTING
A SOURCE REDUCTION AND RECYCLING ELEMENT, A HOUSEHOLD HAZARDOUS WASTE
ELEMENT AND A NONDISPOSAL FACILITY ELEMENT
WHEREAS, the integrated Waste Management Act of 1989 ("AB 939"), as
amended, requires each county and city in the State to prepare and adopt
a plan to divert 25 percent of its solid waste from local landfill(s). by
1995, and 50 percent by the year 2000; and
WHEREAS, AB939 requires each county and city to prepare, and adopt
by resolution; with the required public noticing, a Source Reduction and
Recycling Element, a Household Hazardous Waste Element and a Nondisposal
Facility Element; and
WHEREAS, the City of Fresno on November 15, 1994 held a public
hearing, considering the final Source Reduction and Recycling Element, the
Anal Household Hazardous Waste Element and the final Nondisposal Facility
Element prepared for the City of Fresno, and adopted aIaid documents.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Fresno
that it held a noticed public hearing, considered and adopted the final
Source- Reduction and Recycling Element, the final Household Hazardous
Waste Element and the final Nondisposal Facility Element.

Mayor Patterson announced the time. had arrived to consider the issue and, opened the
hearing. Briefly reviewed by Assistant Public Utilities Director Anderson. Upon call, no one else
wished to speak and Mayor Patterson closed the hearing.
In response to Councilmember Lung (3-- 0) City Managw Bierman advised this issue
would not impact rates, adding rate increases required Council approval. Discussion ensued with
Councilmember Lung expressing-concera regarding current utility rates, and Mr.Bierman-advised
staff-would review available options.

EXECUTIVE SUMMARY
Within the City of Fresno,there is one existing nondisposal facility--a recycling center--and there
is one material sort and recycling/transfer station with an approved land use entitlement and
LEA/IWMB permit pending, but this facility is not yet constructed. There is a private sector
application filed to construct a second material sort and recycling/transfer station,which would be
an expansion and modification of the existing recycling center. The city is planning development
of a co-composting facility which would compost sewage sludge,green waste,and food waste. No
facilities located outside of Fresno are used by the City at this time. The City has formulated goals,
objectives,and policies for nondisposal facility elements. The City's 2025 General Plan document
also contains provisions which would pertain to the siting and development of solid waste and large-
scale recycling facilities.
INTRODUCTION
Purpose of Nondisposal Facility Element
The purpose of the Nondisposal Facility Element is to describe "new facilities and expansion of
existing facility which will be needed to implement the jurisdiction's Source Reduction and
Recycling Element" (Public Resources Code Section 41732).
Regulatory Requirements
The California Integrated Waste Management Act of 1989(Assembly Bill 939-Sher)requires cities
and counties to prepare, adopt and implement Source Reduction and Recycling Elements and
Household Hazardous Waste Elements. It also require counties or regional agencies to prepare
County or Regional Siting Elements and Integration Summary Plans.

• Locate, develop, and regulate these facilities for maximum utility and minimum
adverse impacts on the environment and neighborhoods surrounding the facilities

streets with sufficient traffic capacity for the expected number and types of
vehicle trips associated with these facilities.
• Use landscaping and other aesthetic treatments to screen these facilities from the
view along highways and major streets.
• Apply the Conditional Use Permit(CUP)process and California Environmental
Quality Act review to identify inter-agency requirements,to ensure appropriate
access and urban services are provided, and to fully assess and mitigate impacts
and prevent public nuisances which could otherwise be associated with these
facilities.
• Require indemnification such as clean-up bonds for these operations, to provide
the City of Fresno with the means to ensure nuisance mitigation and site
rehabilitation.

DESCRIPTION OF NONDISPOSAL FACILITIES WITHIN FRESNO
USED TO IMPLEMENT FRESNO'S S121W, PROGRAMS
Existing Facilities
There are currently no existing material sort and recovery facilities within Fresno which are
permitted to handle the full municipal solid waste stream.
Sunset Waste Paper(located at 2721 S. Elm Ave., Fresno, California)has a Conditional
Use Permit for types of non-putrescible waste&recycling, and is under contract with the
City of Fresno for its curbside recycling program.
Proposed Expansions of Existing Facilities
There are no proposed expansions of existing full municipal waste processing facilities at this
time. (There are currently existing facilities of this type, as noted above.)
Sunset Waste Paper has filed a Conditional Use Permit Application for a full material sort
and recovery/transfer station facility, is in the design stage for such a project, and is in
consultation with Fresno County Environmental Health on its solid waste facility permit.
Proposed New Facilities
1. Cedar Avenue Recycling and Transfer Station(City of Fresno CUP Appl.No. C-01-063)

Fresno, California
(Land use entitlement/conditional use permit approved, CEQA clearance issued;
permit application being processed by LEA and IWMB; facility not yet constructed)
This facility is to be located in the incorporated portion of the City of Fresno, in an
area planned and zoned for heavy industrial uses. It will be a material sort and
recovery/transfer station facility with an associated buyback center for recyclables.
Its design capacity is 3,100 tons per day maximum, and its operating statement
includes options for lower tonnage levels of processing. The anticipated waste
diversion rate for this facility is 54%. Material which is not recyclable will be
transported to American Avenue landfill for disposal. The applicant intends to
continue servicing existing accounts of Orange Avenue Disposal, Incorporated(the
Orange Avenue landfill is nearing full capacity and closure), and would like to bid
on servicing the City of Fresno and other incorporated areas and unincorporated area
accounts in the central and eastern portions of Fresno County. (Upon issuance of
the LEA/IWMB solid waste facility permit and construction of this facility, it
will move into the Existing Facility category.)

fifty percent of incoming waste. Initially, the facility is planned to accept 640 tons per
day, which represents approximately fifty percent of the City's waste stream.

USED TO IMPLEMENT FRESNO'S SRRE PROGRAMS
Existing Facilities
At this time,there are no existing facilities outside Fresno used to implement Fresno's SRRE
programs. For temporary and nonresidential service(such as roll-off bin service for construction
debris removal),the following firm has limited operations within the City of Fresno:

This facility is located outside City boundaries and is outside of the City of
Fresno's current Sphere of Influence.
Proposed Expansions of Existing Facilities
No expansions of existing facilities are proposed at this time(as noted above,there are no
existing facilities outside of the City of Fresno which implement the City's SRR$program).
Proposed New Facilities
No new facilities outside of the City of Fresno are proposed at this time.

an expansion and modification of the existing recycling center. The city is planning development
of a co-composting facility which would compost sewage sludge, green waste, and food waste. No
facilities located outside of Fresno are used by the City at this time. The City has formulated goals,
objectives,and policies for nondisposal facility elements. The City's 2025 General Plan document
also contains provisions which would pertain to the siting and development of solid waste and large-
scale recycling facilities.
INTRODUCTION
Purpose of Nondisposal Facility Element
The purpose of the Nondisposal Facility Element is to describe "new facilities and expansion of
existing facility which will be needed to implement the jurisdiction's Source Reduction and
Recycling Element" (Public Resources Code Section 41732).
Regulatory Requirements
The California Integrated Waste Management Act of 1989(Assembly Bill 939-Sher)requires cities
and counties to prepare, adopt and implement Source Reduction and Recycling Elements and
Household Hazardous Waste Elements. It also requires counties or regional agencies to prepare
County or Regional Siting Elements and Integration Summary Plans.
Assembly Bill 3001 (1992 - Cortese-PRC Sections 41730 through 41736) amended AB 939 and
separated nondisposal facilities from the Countywide Siting Element and created the Nondisposal
Facility Element.
A nondisposal facility is defined by PRC Section 40151 as any solid waste facility required to obtain
a state solid waste facility permit other than solid waste disposal and transformation facilities.
Article 6.4 of the California Code of Regulations, Sections 18752 through 18754.5 were developed
to clarify PRC Sections 41730 through 41736. Each jurisdiction must describe all nondisposal
facilities that will be used to manage waste generated within the jurisdiction. Information required
for each facility description is as follows:
1. For facilities within the jurisdiction that recover more than 5 percent of the total volume
received at the facility,the description includes facility name,address or general description

of surrounding area, type of facility, facility capacity, diversion rate expected, and
participating jurisdictions.
2. For transfer stations within the jurisdiction that recover less than 5 percent of the total
volume received at the facility, the description includes facility name, address or general
description of the surrounding area, and participating jurisdictions.
3. For a facility recovering more than 5 percent, but located outside of the jurisdiction, the
description includes facility name,address,facility type,amount of waste sent to the facility
and expected diversion rates.
4. For a transfer station that is located outside of the jurisdiction and recovers less than 5
percent, the description need only include the name and address of the facility.
GOALS AND OBJECTIVES
Goals
• Reduce the amount of waste disposed in landfills by:
reducing the amount of solid waste generated through source reductions and
reuse efforts,
reusing as much of the solid waste generated as possible through recycling,
and
utilizing the nutrient value of solid waste through composting.
• Provide for the safe, efficient, and cost-effective removal of waste from residences,
businesses and industrial sources.
• Assure the development of waste transfer,processing and recovery facilities which
satisfy the highest established environmental standards and regulations.
• Minimize the potential impacts of waste collection, transportation, processing and
recovery facilities upon residential land uses.
• Locate, develop, and regulate these facilities for maximum utility and minimum
adverse impacts on the environment and neighborhoods surrounding the facilities.
Objectives
• Short-Term:
Implement residential and commercial recycling and composting programs
which reduce by 25 percent the solid waste disposed in landfills.

• Medium-Term:
- Implement and expand source reduction,recycling, composting and public
education programs aimed at reducing by 50 percent the solid waste
disposed in landfills.
In cooperation with the private sector and governmental agencies, provide
for the construction of materials recovery, composting, and waste transfer
facilities.
Policies
• Give highest priority to reducing the production and generation of waste.
• Provide recycling and composting opportunities for residents and businesses as a
means of conserving natural resources and landfill capacity.
• Implement programs and develop subregional multi-functional facilities on a
multijurisdictional basis to achieve economies of scale and reduce costs to
ratepayers.
• Site transfer stations and material sort and recycling facilities in areas which are
planned for heavy industrial uses, on land zoned for heavy industrial use.
• Transfer stations and material sort and recycling facilities shall be adequately
distanced from residential areas and sensitive land uses.
■ Site transfer stations and material sort and recycling facilities on designated major
streets with sufficient traffic capacity for the expected number and types of
vehicle trips associated with these facilities.
• Use landscaping and other aesthetic treatments to screen these facilities from the
view along highways and major streets.
• Apply the Conditional Use Permit(CUP)process and California Environmental
Quality Act review to identify inter-agency requirements, to ensure appropriate
access and urban services are provided, and to fully assess and mitigate impacts
and prevent public nuisances which could otherwise be associated with these
facilities.
• Require indemnification such as clean-up bonds for these operations, to provide
the City of Fresno with the means to ensure nuisance mitigation and site
rehabilitation.

USED TO IMPLEMENT FRESNO'S SRRE PROGRAMS
Existing Facilities
There are currently no existing material sort and recovery facilities within Fresno which are
permitted to handle the full municipal solid waste stream.
Cedar Avenue Recycling and Transfer Station(located at 3457 South Cedar Avenue,
Fresno, California)has a Conditional Use Permit for a material sort and recovery/transfer
station facility with an associated buy-back center for recyclables.
Sunset Waste Paper(located at 2721 South Elm Avenue, Fresno, California) has a
Conditional Use Permit for types of non-putrescible waste &recycling, and is under
contract with the City of Fresno for its curbside recycling program.
Proposed Expansions of Existing Facilities
There are no proposed expansions of existing full municipal waste processing facilities at this
time. (There are currently existing facilities of this type, as noted above.)
Sunset Waste Paper Material Recovery Facility and Transfer Station(City of Fresno
Conditional Use. No. C-02-068)

(Land use entitlement/conditional use permit approved, CEQA clearance issued;
permit application being processed by LEA and CIWMB; facility not yet constructed.)
This facility is to be located in the incorporated portion of the City of Fresno, in an
area planned and zoned for heavy industrial uses. It will be a material sort and
recovery/transfer station facility. Its design capacity allows for a maximum of 2,000
tons per day(TPD) and its operating statement includes options for lower tonnage
levels of processing. The anticipated waste diversion rate for this facility is 30%.
Material which is not recyclable will be transported to the American Avenue landfill
for disposal. The applicant currently serves the City of Fresno and intends to
continue servicing existing accounts in the unincorporated areas of Fresno, Kern,
Kings, Tulare and Merced Counties. (Upon issuance of the LEA/CIWMB solid
waste facility permit and construction of the transfer facility,it will move into
the Existing Facility category.)

fifty percent of incoming waste. Initially, the facility is planned to accept 640 tons per
day, which represents approximately fifty percent of the City's waste stream.
